Decree of the President of the Republic of Kazakhstan dated August 25, 2014 No. 898.

In accordance with subparagraph 3) of Article 44 of the Constitution of the Republic of Kazakhstan, subparagraph 14) of Article 10 of the Constitutional Law of the Republic of Kazakhstan dated December 26, 1995 "On the President of the Republic of Kazakhstan" in order to delineate powers between levels of government aimed at creating a compact and effective executive branch of the Republic of Kazakhstan, streamlining and improving the effectiveness of the public administration system, and based on the principles of a unitary state structure,

I DECREE:

1. To define the following principles of public administration based on the differentiation of functions and powers between the levels of public administration in the Republic of Kazakhstan, increasing the independence and responsibility of central and local executive bodies:

1) to assign functions to the Government of the Republic of Kazakhstan as the body heading the system of executive bodies and managing their activities in the following basic areas:

development of the main directions of the socio-economic policy of the state, its defense capability, security, ensuring public order and the organization of their implementation;

organization of state property management;

development of measures for the implementation of the State's foreign policy;

ensuring control over the observance of legality in the formation and use of state currency, financial and material resources;

formation of the system and conditions of remuneration, social protection of citizens, state social security and social insurance;

ensuring the implementation of legal policy; development and implementation of measures to protect and protect the rights and freedoms of citizens, ensure law and order, security and defense capability of the Republic of Kazakhstan, territorial integrity and protection of the state borders of the Republic of Kazakhstan;

implementation of other functions and directions assigned to the Government of the Republic of Kazakhstan by the Constitution, laws and acts of the President of the Republic of Kazakhstan;

2) to assign to the central executive bodies:

implementation of strategic, regulatory, implementation and control and supervisory functions within their competence;

formation and implementation of state policy in the relevant field of management;

approval of regulatory legal acts on the implementation of state policy in the relevant industry (sphere);

coordinating the activities of central and local executive bodies for the implementation of state policy in the relevant industry (sphere);

exercising control and supervision over the activities of individuals and legal entities within the scope of their competence;

exercising control and supervisory functions over the activities of central and local executive bodies on issues within the competence of ministries;

implementation of regulatory legal acts, strategic and program documents, achievement of goals and objectives in the relevant industry (sphere);

establishment and approval of mandatory requirements for private business entities;

development and approval of standards and regulations for public services;

provision of public services;

implementation of other functions and directions assigned to the central executive bodies by the Constitution, laws, acts of the President and the Government of the Republic of Kazakhstan;

3) departments that are part of the central executive bodies may be charged with:

implementation of regulatory, implementation, control and supervisory functions and participation in the implementation of strategic functions of the central executive body within the competence of the department;

approval of normative legal acts on issues within the competence of the department, and if there is direct competence for their approval in the acts of ministries, with the exception of normative legal acts affecting human and civil rights and freedoms.;

exercising control and supervision over the activities of individuals and legal entities within the scope of their competence;

exercising control and supervisory functions over the activities of local executive bodies on issues related to the authority of the department;

implementation of other functions and directions assigned to the agency by the legislation of the Republic of Kazakhstan;

4) assign responsibility to local executive bodies:

implementation of regulatory, implementation and control and supervisory functions that ensure the solution of tasks of local importance within the relevant administrative-territorial unit;

ensuring the implementation of the national policy of the executive branch in combination with the interests and needs of the development of the relevant territory;

adoption of regulatory legal acts ensuring the solution of tasks of local importance and the implementation of state policy in the relevant territory;

communal property management;

development of plans, economic and social programs for the development of the territory, the local budget and ensuring their implementation;

implementation of control and supervision over the activities of individuals and legal entities within the relevant territory;

participation in the provision of activities for the protection of public order and security in the relevant territory;

provision of public services of local importance;

other powers assigned to local executive bodies by the legislation of the Republic of Kazakhstan.

2. In accordance with the principles of separation of powers established by paragraph 1 of this Decree, transfer functions from the Government of the Republic of Kazakhstan to the central executive bodies, as well as to the local executive bodies in accordance with Annex 1 to this Decree.

3. Transfer functions from the central executive bodies to the relevant central executive bodies in accordance with Annex 2 to this Decree.

4. Transfer functions from central executive bodies to local executive bodies in accordance with Appendix 3 to this Decree.

5. Transfer functions from local executive bodies of regions, Astana, Almaty cities to the jurisdiction of local executive bodies of districts (cities of regional significance) in accordance with Appendix 4 to this Decree.

6. Transfer state functions to the sphere of the non-governmental sector, as well as exclude certain functions of state bodies in accordance with Annex 5 to this Decree.

7. To the Government of the Republic of Kazakhstan:

1) in order to ensure effective management and efficiency, take the necessary measures on the transfer of material and technical support, staffing levels between ministries and local executive bodies and optimization of republican state-owned enterprises;

2) to ensure, in coordination with the Administration of the President of the Republic of Kazakhstan, the distribution of functions and tasks between central executive bodies and departments in accordance with their sectoral characteristics;

3) in accordance with the principles of separation of powers defined by this Decree, ensure, if necessary, the redistribution of other functions provided for in the legislative acts of the Republic of Kazakhstan and not specified in the annexes to this Decree;

4) submit a draft law aimed at implementing this Decree to the Mazhilis of the Parliament of the Republic of Kazakhstan by September 1, 2014.;

5) take other measures to implement this Decree.

8. To make the following amendment to the Decree of the President of the Republic of Kazakhstan dated September 29, 2004 No. 1449 "On measures to further improve the public administration system of the Republic of Kazakhstan" (SAPP of the Republic of Kazakhstan, 2004, No. 36, Article 474):

Delete paragraph 1.

9. Control over the implementation of this Decree is entrusted to the Administration of the President of the Republic of Kazakhstan.

10. This Decree shall enter into force from the date of its signing.

The list of functions transferred from the Government of the Republic of Kazakhstan to the central executive bodies, as well as to the local executive bodies.1 List of functions transferred from the Government of the Republic of Kazakhstan to the central executive bodies

1. In the field of taxes and customs:

1) approval of the procedure for reporting by a customs representative to the customs authorities, including through the use of information technology;

2) approval of the accounting procedure for goods transported in accordance with the customs procedure of customs transit, and submission to the customs authorities of reports on the transportation of such goods, including using information technology;

3) approval of the accounting procedure for stored goods and submission of reports on them to the customs authorities, including through the use of information technology;

4) approval of the procedure for keeping records of goods stored in a customs warehouse and reporting on such goods to the customs authorities, including through the use of information technology;

5) approval of the procedure for relations between customs authorities and owners of vacant warehouses;

6) approval of the procedure for the relationship of customs authorities with the participants of the special economic zone;

7) approval of the rules for transferring to the budget, refunding (offsetting) excessively (erroneously) paid or excessively collected amounts of customs duties, taxes, and penalties from the budget that are not regulated by the Code "On Customs Affairs in the Republic of Kazakhstan" and the Customs Code of the Customs Union;

8) approval of the procedure for accounting for receipts to the budget of customs duties, taxes, customs duties and penalties, as well as maintaining personal accounts of the payer in the part not regulated by the Code "On Customs Affairs in the Republic of Kazakhstan";

9) approval of the accounting procedure in the customs authorities for ensuring payment of customs duties and taxes;

10) approval of the procedure for refunding (offsetting) excessively (erroneously) paid or excessively collected amounts of export customs duties, taxes and customs duties, amounts of advance payments, amounts of security for payment of customs duties and taxes;

11) approval of the procedure for the refund (offset) of excessively (erroneously) paid or excessively collected amounts of import customs duties;

29) approval of the rules for the receipt, accounting, storage and issuance of excise and accounting control stamps;

30) approval of the rules for registration, ordering, receiving, issuing, accounting, storage and presentation of accompanying invoices for certain types of excisable goods;

31) approval of the procedure for organizing the activities of the excise post;

32) approval of tax reporting forms and rules for their preparation;

33) approval of the notification form on receipt of an application for the import of goods and payment of indirect taxes.

2. In the field of trade:

1) approval of internal trade rules;

2) approval of the procedure for setting retail price thresholds for socially significant food products and the maximum allowable retail prices for them;

3) approval of retail price thresholds for socially important food products;

4) approval of the maximum allowable retail prices for socially significant food products;

5) approval of the standard rules of stock trading;

6) approval of qualification requirements for the activities of commodity exchanges, stock brokers and dealers.

3. In the field of state and budget planning, auditing, public procurement, state property:

1) approval of the procedure for opening, maintaining and closing accounts of state institutions in the central authorized body for budget execution;

2) approval of the procedure for registration and accounting of state concession obligations in the central authorized body for budget execution;

3) approval of the procedure for payment of subsidies from the budget;

4) approval of the procedure for financing budget programs aimed at making a targeted contribution;

5) approval of the procedure for determining the limits of expenditures of administrators of budget programs, limits on new initiatives;

6) approval of strategic plans of government agencies;

7) approval of the procedure for the accreditation of professional auditing organizations;

8) approval of the accounting procedure;

9) approval of the rules for budget execution and its cash management;

10) approval of the rules for the development and adjustment, carrying out the necessary examinations of the investment proposal, as well as planning, consideration, selection, monitoring and evaluation of the implementation of budget investments;

11) determining the procedure for the formation and maintenance of registers in the field of public procurement;

12) approval of the rules for conducting electronic public procurement;

13) establishment, in accordance with the procedure determined by the Government of the Republic of Kazakhstan, of a standard for deducting a portion of the net income of republican state-owned enterprises.

4. In the field of architecture, urban planning, housing and communal services, natural monopolies, protection of competition:

1) approval of the procedure for providing equal conditions to consumers of regulated services;

2) establishing the procedure for determining the reasonable amount of consumption by individuals of regulated water supply services;

3) approval of standard contracts concluded by subjects of natural monopolies with consumers of regulated services;

4) determining the procedure for approving the investment program of a natural monopoly entity;

5) determining the procedure for holding public hearings;

6) determination of the procurement procedure;

7) to develop a procedure for determining the marginal price for the retail sale of petroleum products for which state price regulation has been established;

8) setting the level of marginal prices for the wholesale sale of commercial and liquefied petroleum gas on the domestic market;

9) determining the procedure for monitoring facilities and complexes under construction (planned for construction);

10) approval of the rules for the provision of engineering services in the field of architectural, urban planning and construction activities;

11) approval of technical regulations;

12) establishment of the procedure for attestation of state construction inspectors carrying out architectural and construction control and supervision;

13) establishing the procedure for attracting organizations to provide engineering services for projects funded from budgetary funds;

14) approval of the procedure for certification of experts performing expert work and engineering services in the field of architectural, urban planning and construction activities;

15) approval of the rules for control and supervision by the authorized state body for architecture, urban planning and construction over the activities of local executive bodies in the field of architectural, urban planning and construction activities;

16) approval of the rules for the organization and conduct of copyright supervision;

17) approval of the rules for classifying buildings and structures as technically and (or) technologically complex design objects;

18) approval of standard building regulations;

19) approval of standard rules for the maintenance and protection of green spaces, rules for the improvement of territories of cities and settlements.

5. In the field of land relations, geodesy and cartography, housing relations:

1) approval of the list of topographic, geodetic and cartographic works performed at the expense of the republican budget;

2) approval of regulatory legal acts establishing requirements for private business entities in the field of geodesy and cartography;

3) approval of the rules for the formation, collection, storage and use of documents of the National Cartographic and Geodetic Fund of the Republic of Kazakhstan;

4) approval of the rules on the protection of geodetic points;

5) approval of the procedure for the transfer of forest fund lands to lands of other categories for purposes not related to forestry;

6) approval of the procedure for maintaining the state land cadastre and land monitoring;

7) approval of the rules for the provision of land plots occupied by territorial waters for the construction of artificial structures;

8) approval of the rules for granting rights to land plots for individual housing construction;

9) establishment of standards for compensation of losses of agricultural production caused by the seizure of agricultural land for their use for purposes not related to agriculture;

10) approval of the procedure for compensation of losses with offsetting of the amounts spent on restoration of lands;

11) approval of the procedure for monitoring land and the use of its data;

12) approval of the rules for the maintenance of the common property of the condominium facility;

13) determination of the unified procedure for state accounting of the housing stock of the Republic of Kazakhstan.

6. In the field of defense:

1) approval of the rules of military training in higher educational institutions and military faculties at organizations of higher professional education;

2) approval of the rules on the procedure for keeping military records of conscripts and conscripts;

3) approval by an interdepartmental act of the rules for the establishment of restricted areas at arsenals, bases and depots of the Armed Forces, other troops and military formations and restricted areas at arsenals, bases and depots of the Armed Forces, other troops and military formations;

4) approval of the rules of organization of activities and conditions of service of employees of the military attaches of the Ministry of Defense of the Republic of Kazakhstan;

5) keeping records of military assets under their operational control;

6) approval of the regulations on local military administration bodies;

7) approval of the rules for the investigation of aviation accidents and incidents;

8) approval of standards for the supply of clothing and other types of property;

9) approval of the rules of preparation of citizens for military service;

10) approval of the procedure for organizing and conducting, as well as the formation of the educational and material base for initial military training;

11) approval of the universal military training program;

12) approval of the rules of military registration of conscripts and conscripts and the rules of military medical examination;

13) implementation of conscription for military training;

14) approval of the list of localities in which military personnel who are on flight work, shipboard service, on combat duty, combat service, leave duration of 40 days is established regardless of length of service.;

15) approval of the amount of compensation for postal items to conscripts, cadets of the first and second courses of military educational institutions;

16) approval of the list of special vehicles;

17) approval of the rules of state registration of motor vehicles and trailers to them of the Armed Forces, other troops and military formations of the Republic of Kazakhstan.

7. In the field of subsoil use and the environment:

1) approval of the rules for the use of water supply and sanitation systems in settlements;

2) approval of standard rules for calculating utility consumption rates for water supply and sanitation for consumers who do not have metering devices;

3) approval of the rules for the technical operation of water supply and sanitation systems in settlements;

4) approval of the procedure for leasing and trust management of water facilities providing water supply to cities and rural settlements;

5) approval of the procedure for the purchase of goods, works and services during subsurface use operations;

6) approval of the procedure for the formation and maintenance of the register of goods, works and services used in conducting subsurface use operations and their producers, including the criteria for their assessment for inclusion in this register;

7) determining the procedure for monitoring and monitoring compliance with the terms of contracts;

8) establishment of the procedure for state monitoring of subsurface resources;

9) establishment of rules for the examination of draft contracts for subsurface use;

10) approval of uniform rules for the rational and integrated use of subsurface resources in the exploration and extraction of minerals;

11) approval of the rules for the use of state-owned geological information for educational, scientific, and commercial purposes and for the export of geological information outside the territory of the Republic of Kazakhstan;

3) establishment of energy efficiency requirements for buildings, structures, structures and their elements that are part of the enclosing structures;

25) approval of the list of dangerous goods allowed for transportation by motor vehicles on the territory of the Republic of Kazakhstan;

26) approval of the rules for the use of motorways;

27) approval of financing standards for the repair and maintenance of public roads of international and national importance;

28) approval of the procedure for payment and rates of fees for travel through the territory of the Republic of Kazakhstan of motor vehicles;

29) approval of the procedure and operating conditions for toll roads and public bridge crossings of international and national importance;

30) making a decision on the use of a public highway (section) of international and national significance on a paid basis;

31) approval of the list of public roads of international and national importance, including the list of defense-use roads;

32) approval of the procedure for placing outdoor (visual) advertising in the right-of-way of public roads;

33) approval of financing standards for the repair and maintenance of streets of the capital, cities of republican significance, highways of regional and district significance;

34) approval of the airworthiness standards of civil aircraft of the Republic of Kazakhstan;

35) approval of the rules of professional training of aviation personnel directly involved in ensuring flight safety;

36) approval of the list of positions and professions of civil and experimental aviation personnel subject to certification;

37) approval of the rules of admission to flights of general aviation operators;

38) approval of the rules for the admission of civil aviation organizations of the Republic of Kazakhstan to the application of aviation standards of international organizations in the field of civil aviation;

39) approval of airfield maintenance rules in civil aviation;

40) approval of the rules for the provision of aviation fuels and lubricants for civil aircraft;

41) approval of the rules for the organization of passenger services at airports of the Republic of Kazakhstan;

42) approval of fire safety rules in civil aviation of the Republic of Kazakhstan;

43) approval of the rules of emergency flight support at airports of the Republic of Kazakhstan;

44) approval of the rules for pre-flight and special inspections of aircraft;

45) approval of the rules for the admission of airlines to perform scheduled domestic commercial air transportation;

46) approval of the rules for the carriage of passengers, baggage and cargo by air;

47) approval of the rules of state registration of courts and their rights;

48) approval of the rules of transportation of passengers, baggage and cargo;

49) approval of the rules for the certification of boatmasters for the right to operate a small vessel;

50) approval of the list of dangerous goods intended for transportation by ships;

51) determination of the National Maritime Carrier and approval of its regulations;

52) approval of the list of mandatory seaport services;

53) approval of the rules for the certification of boatmasters for the right to operate a small vessel;

54) approval of the rules of navigation on inland waterways;

55) approval of the rules for the allocation of frequency bands, radio frequencies (radio frequency channels) for broadcasting purposes;

56) approval of the procedure for determining the calculated tariff, approval of marginal and individual tariffs.

10. In the field of energy, oil and gas, industry:

1) approval of the rules for conducting energy expertise;

2) approval of safety regulations for the operation of electrical installations;

3) approval of the rules for the use of electric energy;

4) approval of the rules for the use of thermal energy;

5) approval of the rules of technical operation of electrical installations of consumers;

6) approval of fire safety regulations for energy companies;

7) approval of the list of diseases related to exposure to ionizing radiation and the procedure for establishing a causal relationship;

8) approval of the procedure for conducting oil operations at sea, inland waters, in areas of environmental emergency and in specially protected natural areas;

9) approval of the methodology for calculating standards and volumes of combustion of associated and (or) natural gas during oil operations;

10) approval of the procedure for issuing permits for flaring associated and (or) natural gas;

11) approval of the rules of accreditation of gas grid organizations;

12) approval of the procedure for the retail sale and use of commercial and liquefied petroleum gas;

13) approval of the rules for the operation of main oil pipelines and the rules for the operation of main gas pipelines;

14) approval of the rules for the organization of protection of main pipelines;

15) approval of the procedure for monitoring the production and sale of petroleum products;

16) approval of the rules for the supply of petroleum products by a single operator for the supply of petroleum products to the Armed Forces of the Republic of Kazakhstan, the Border Service of the National Security Committee of the Republic of Kazakhstan, the Internal Troops of the Ministry of Internal Affairs of the Republic of Kazakhstan, the Republican Guard of the Republic of Kazakhstan, the authorized body in the field of civil protection.

11. In the field of agriculture, water resources, forestry and wildlife:

1) approval of the procedure for using the money allocated to support compulsory insurance in crop production and the amount of payment for the agent's services;

2) development of the main policy directions in the field of state support of grain production and organization of their implementation;

3) determining the size of grain supplies by grain exporters to the state grain resources, calculated as a percentage of the exported volume;

4) approval of the rules for quantitative and qualitative accounting of grain, grain storage, issuance, circulation and repayment of grain receipts, temporary management of a grain receiving enterprise, and the use of an electronic grain receipt system;

5) approval of the list of especially dangerous harmful organisms;

6) approval of the rules for registration, production tests and state registration of pesticides (pesticides);

7) approval of the procedure for maintaining and submitting veterinary records and reports;

8) approval of veterinary (veterinary and sanitary) regulations;

9) approval of the rules for certification of individuals and legal entities engaged in entrepreneurial activities in the field of veterinary medicine;

10) approval of the procedure for certification of veterinarians of production control units;

11) approval of the rules of veterinary and sanitary examination;

12) approval of the rules for the establishment or lifting of restrictive measures and quarantine;

13) approval of the regulations on state veterinary and sanitary control and supervision;

14) approval of the procedure for the disposal and destruction of biological waste;

15) approval of the procedure for issuing permits for the export, import and transit of transported (transported) objects, taking into account the assessment of the epizootic situation in the relevant territory;

16) approval of the list of particularly dangerous animal diseases, in which mandatory seizure and destruction of animals, products and raw materials of animal origin that pose a danger to animal and human health are carried out;

17) approval of the rules for the protection of the territory of the Republic of Kazakhstan from quarantine facilities and alien species;

18) approval of the list of quarantine facilities and alien species, in relation to which plant quarantine measures are being established and implemented;

19) approval of phytosanitary requirements for imported quarantined products;
