On measures for further optimization of the system of state bodies of the Republic of Kazakhstan

On measures for further optimization of the system of state bodies of the Republic of Kazakhstan

Decree of the President of the Republic of Kazakhstan dated September 18, 1998 No. 4073 in order to further improve the public administration system in the Republic of Kazakhstan, increase the efficiency of activities and strengthen the responsibility of civil servants

I decree:    

1. To reduce the number of staff with the corresponding expenses for their maintenance of the following state bodies:      

1) The National Security Committee of the Republic of Kazakhstan - for 1,000 military officers;      

2) The General Prosecutor's Office of the Republic of Kazakhstan - for 500 employees.      

2. The Government of the Republic of Kazakhstan should ensure a reduction in the staffing of the internal affairs bodies of the Republic of Kazakhstan by 1,500 military officers with appropriate expenses for their maintenance.      

3. To establish that the dismissed employees of the state bodies listed in paragraphs 1, 2 of this Decree are provided with social guarantees and compensations provided for by the legislation of the Republic of Kazakhstan.      

4. To establish the Agency of the Republic of Kazakhstan for Civil Service Affairs (hereinafter referred to as the Agency) as a government agency directly subordinate to and accountable to the President of the Republic of Kazakhstan.      

5. Assign the following main tasks to the Agency::      

1) developing proposals and taking measures to improve the civil service system and the organization of civil servants' work;      

2) monitoring the state of civil service personnel, including the formation of a civil service personnel reserve;      

3) training, retraining and advanced training of civil service personnel, including the placement of a state order for the training of employees for the civil service system;      

4) organization of work to improve the system of remuneration for civil servants and other measures of their social and legal protection;      

5) developing proposals and taking measures to improve legislation on civil service, including the development and adoption of regulatory legal acts on admission to public service, its passage, and certification of civil servants; 6) monitoring compliance with legislation on civil service, including monitoring compliance with the rules of official ethics of civil servants;      

7) ensuring the activities of the Supreme Disciplinary Council of the Republic of Kazakhstan.      

 

6. To abolish the secretariat of the Supreme Disciplinary Council of the Republic of Kazakhstan in the structure of the Administration of the President of the Republic of Kazakhstan.      

 

7. The Administration of the President of the Republic of Kazakhstan, the Office of the Prime Minister of the Republic of Kazakhstan, the Ministry of Finance of the Republic of Kazakhstan, the Ministry of Labor and Social Protection of the Population of the Republic of Kazakhstan within one month:      

1) to reorganize and reduce the staffing of the relevant structural divisions with the transfer of this staffing to the Agency;      

2) transfer to the Agency the functions and powers of the reorganized structural divisions, the necessary material and technical means and other property of the state bodies listed in paragraph 7 of this Decree, to the extent of the tasks assigned to the Agency and the staffing transferred to the Agency;      

3) bring its structure and staffing levels in line with this Decree.      

 

8. The following amendment should be made to the Regulation on the Supreme Disciplinary Council of the Republic of Kazakhstan, approved by Decree of the President of the Republic of Kazakhstan dated October 21, 1997 No. 3705 "On the Supreme Disciplinary Council of the Republic of Kazakhstan": in paragraph 4, the words "Head of the Presidential Administration of the Republic of Kazakhstan" should be replaced by the words "Chairman of the Agency of the Republic of Kazakhstan for Civil Service Affairs".      

 

9. To the Government of the Republic of Kazakhstan within one month:      

1) to increase the staffing of the Customs Committee of the Ministry of Finance of the Republic of Kazakhstan by reducing the staffing of government agencies listed in paragraphs 1, 2 of this Decree;      

2) to ensure the financing of the Agency's activities at the expense of the appropriations provided by the republican budget for 1998 for the maintenance of the state bodies listed in paragraph 7 of this Decree, within the limits of funds allocated for the maintenance of the part of the staffing, logistical and other assets of these bodies transferred to the Agency;      

3) annually provide funds for the maintenance of the Agency in the draft republican budget;      

4) bring their acts in line with this Decree;      

5) take other measures resulting from this Decree.      

 

10. The Administration of the President of the Republic, the National Security Committee of the Republic, the Prosecutor General's Office of the Republic, within one month, submit proposals to the Head of State for consideration on bringing previously issued acts of the President of the Republic of Kazakhstan in accordance with this Decree.      

 

11. The Agency should submit it to the Head of State for consideration within one month.:      

1) draft Regulations on the Agency of the Republic of Kazakhstan for Civil Service Affairs;      

2) proposals on the structure and overall staffing of the Agency.      

12. Control over the implementation of this Decree is entrusted to the Administration of the President of the Republic of Kazakhstan.      

13. This Decree comes into force from the date of signing.
