In accordance with paragraph 1 of Article 16 of the Decree of the President of the Republic of Kazakhstan, which has the force of law, dated December 12, 1995, No. 2679 "On the procedure for concluding, executing and denouncing international treaties of the Republic of Kazakhstan", I decree:

     1. To approve the Agreement between the Republic of Kazakhstan and Ukraine on Economic Cooperation for 1999-2009, signed on September 17, 1999 in Kiev.

     2. This Decree comes into force from the date of signing.

Agreement *between the Republic of Kazakhstan and Ukraine on Economic cooperation 1999-2009

     The Republic of Kazakhstan and Ukraine, hereinafter referred to as the "High Contracting Parties", guided by the Treaty of Friendship and Cooperation between the Republic of Kazakhstan and Ukraine dated January 20, 1994, the Agreement between the Government of the Republic of Kazakhstan and the Government of Ukraine on Free Trade dated September 17, 1994, confirming the provisions of the Declaration on the Further Development of Cooperation between the Republic of Kazakhstan and Ukraine dated On October 14, 1997, recognizing that economic cooperation is primarily aimed at, to improve the standard of living and meet the needs of the population of the two states, realizing the advantages of the international division of labor, specialization and cooperation of production, mutually beneficial trade to achieve the goals of their socio-economic development, based on the need to further strengthen and develop equitable and mutually beneficial trade, economic and industrial relations, giving them a long-term and sustainable character, effective use of economic the potential of the two States and the improvement of the welfare of their peoples,      Reaffirming the need for mutually beneficial use of the productive and intellectual potential of their States and striving to further deepen comprehensive cooperation, attaching great importance to the implementation of economic reforms, creating conditions for a phased transition to the free movement of goods, services, capital and labor, guided by generally recognized norms and principles of international law, agreed as follows:

 

                               Article 1

     The High Contracting Parties shall implement the Program of Economic Cooperation between the Republic of Kazakhstan and Ukraine for 1999-2009 (hereinafter referred to as the Program), which is an integral part of this Agreement.

 

                               Article 2

     The economic cooperation of the High Contracting Parties is carried out on the principles of long-term partnership and a free trade regime that meets the strategic interests of both States, through interaction between regions and business entities, regardless of their forms of ownership, in accordance with generally recognized norms of international law and national legislation.

 

                               Article 3

     The High Contracting Parties, recognizing the need for mutually beneficial cooperation and the gradual formation and development of a common economic space within the CIS, create favorable conditions for the convergence of the regulatory framework in the field of foreign economic activity, trade and economic relations, tax, customs and tariff system, antimonopoly policy and consumer protection, the formation of individual projects and programs, the provision of to promote the development of mutually beneficial economic, scientific and technical ties between business entities, to enhance the mutual activities of national and foreign investors in the territory of both States.      The High Contracting Parties shall refrain from actions detrimental to the interests of each other's economy.

 

                               Article 4

     The High Contracting Parties: jointly develop and implement a system of measures to support and protect national commodity producers engaged in joint production; encourage the formation of transnational associations, financial and industrial groups, holdings, and joint ventures for the production of new-generation machinery based on in-depth production cooperation; recognize mutual interest in strengthening mutually beneficial ties between enterprises of basic industries and agriculturalindustrial complexes;      They encourage the opening of trading houses and representative offices.

 

                               Article 5

     The High Contracting Parties create favorable conditions for the promotion and mutual protection of investments, support for entrepreneurship in cooperation on the securities market, and the development of exchange trading.

 

                               Article 6

     The High Contracting Parties, on a mutually beneficial basis, ensure cooperation in conducting fundamental and applied scientific research within the framework of international projects, including the organization of joint scientific work on issues of common interest.

 

                               Article 7

     The High Contracting Parties will continue cooperation in the field of transport and communications, and create favorable conditions for transit through their territories.

 

                               Article 8

     The High Contracting Parties instruct their Governments and the Joint Interstate Commission for Economic Cooperation between the Republic of Kazakhstan and Ukraine to coordinate the implementation of the Program, monitor the progress of its implementation and, if necessary, develop proposals for amendments to it.

 

                               Article 9

     The High Contracting Parties will resolve the differences arising in the interpretation of the provisions of this Treaty through negotiations and consultations.      By mutual agreement of the High Contracting Parties, this Treaty may be amended and supplemented by separate Protocols, which are an integral part of this Treaty.

 

                               Article 10

     This Treaty does not affect the rights and obligations of the High Contracting Parties arising from other international treaties to which they are parties.

 

                           Article 11

     This Treaty shall enter into force on the date of receipt of the last written notification on the completion by the High Contracting Parties of the internal procedures necessary for the entry into force of the Treaty and shall be valid until December 31, 2009.      Each of the High Contracting Parties may terminate this Agreement by written notification to the other High Contracting Party. In this case, the Agreement shall terminate after 6 (six) months from the date of receipt of such notification.      Termination of this Agreement does not affect the implementation of projects implemented in accordance with the Program.

     Done in Kiev on September 17, 1999, in two original copies, each in the Kazakh, Ukrainian and Russian languages, all texts having the same legal force.

     In case of disagreement in the interpretation of the provisions of this Treaty, the High Contracting Parties shall use the text in Russian.

The program of long-term economic cooperation between the Republic of Kazakhstan and Ukraine for 1999-2009

     The Republic of Kazakhstan and Ukraine are priority economic partners. The mutual economic interests of both countries are primarily determined by the high level of historically established industrial, economic and technical ties between many sectors of the economy, and the objective need to preserve and further develop them on a mutually beneficial and equitable basis.      Striving to further develop and specify the relationship, recognized agreements reflected in the Treaty of Friendship and Cooperation between the Republic of Kazakhstan and Ukraine dated January 20, 1994, the Agreement between the Government of the Republic of Kazakhstan and the Government of Ukraine on Free Trade dated September 17, 1994, the Agreement on the Further Development and Expansion of Economic Cooperation between the Republic of Kazakhstan and Ukraine from September 21st, 1995, This Program of long-term trade and economic cooperation between the Republic of Kazakhstan and Ukraine (hereinafter referred to as the "Program") has been developed.

Goals and objectives of the Program

     The program was developed with the aim of implementing by the Republic of Kazakhstan and Ukraine on a long-term basis an agreed set of measures, including regulatory and legal ones, to provide state assistance to the development of mutually beneficial economic, scientific and technical ties between the two countries, to achieve significant progress in industrial cooperation between the leading sectors of national economies and the growth of mutual trade on this basis, as well as to meet the spiritual and cultural needs of the peoples of Kazakhstan and Ukraine and to raise the standard of living of the population of the two Sides.      To achieve the goals of the Program, it is envisaged: - setting priorities for the development of economic cooperation; - convergence of conceptual approaches in the structural restructuring of the economies of both countries, creating incentives for economic entities to increase production, invest in its development, introduce the latest scientific achievements and advanced technologies, improve the quality and competitiveness of products; - interaction in the formation of a market economy, in particular implementation of institutional transformations.

     In the process of implementing the Program, the following tasks will be solved: - convergence of the regulatory framework in the areas of regulation of foreign economic activity and the tax system, implementation of measures to protect national producers; - formation of separate interstate projects and programs of economic cooperation, creation of joint ventures; - effective use and development of transport communications and communications; - interaction in the development of stock markets markets;      - creation of a unified information space in the field of competition and consumer protection; - implementation of measures to strengthen and develop humanitarian cooperation, interaction in social, cultural and other spheres; - implementation of coordinated actions to protect the environment, improve the environmental situation, eliminate the consequences of natural disasters and catastrophes;      - cooperation in combating economic crime, violations of customs and tax legislation, organized crime, terrorism, illegal distribution and sale of narcotic and psychotropic drugs; - coordinated cooperation in the application of space technology, the creation of new space materials and technologies for space research.

 

Coordination of priority directionsstructural changes in economies

     The main strategic guidelines are considered to be: - achieving stabilization of national industries and their economic growth; - increasing the competitiveness of products; - developing the export potential of the Parties.      The transformations to be carried out in the Republic of Kazakhstan and Ukraine as part of a coordinated structural policy are associated with a deep qualitative restructuring of the existing industrial potential and affect the interests of both states.      In this regard, the Parties will consider proposals on the joint creation and development of structural industries, on ways and forms of equity participation in providing these industries with the necessary resources, and maintaining the production profile of enterprises that are key to ensuring the economic security of the Republic of Kazakhstan and Ukraine.      Such industries primarily include the fuel and energy complex, the defense industry, mechanical engineering, agricultural production, shipbuilding and the light food industry, as well as the preservation and enhancement of scientific and technical potential, cooperation in the field of space exploration and use.      Interstate targeted comprehensive programs in accordance with the structural restructuring of the industries of both countries will provide for a set of measures aimed at: - moving capital to the most promising sectors of the economy; - curtailing inefficient, uncompetitive industries and industries; - increasing the competitiveness of products.      During the implementation of the Program, effective measures will be taken: - to strengthen and develop mutually beneficial direct industrial relations;      - to increase the production of progressive types of products; - for the effective integrated use of raw materials; - for the development of import-substituting industries.

Development of trade relations

     The development and deepening of trade cooperation between the Republic of Kazakhstan and Ukraine will be carried out with the subsequent liberalization of the free trade regime in force between the states, the transition to uniform principles of indirect taxes in mutual trade, the gradual elimination of trade and technical barriers and indirect non-tariff restrictions.      The program provides for the interaction of the transport systems of the Republic of Kazakhstan and Ukraine, including oil and gas pipelines, through which export-import supplies of energy resources are carried out, bearing in mind their more efficient use in mutual cargo transportation, reduction of transportation costs, and the implementation of a coordinated policy for the development and reconstruction of transport systems for this purpose.      The organization and implementation of trade relations between countries involves the regular exchange of necessary statistical information. It provides for the exchange of statistical publications and publications, methodological materials and developments, programs, as well as experience in conducting statistical observations, censuses, surveys, and coordination of principles for the formation of foreign trade statistics. Information will be provided according to an agreed list of indicators by the relevant departments of the Republic of Kazakhstan and Ukraine.

Cooperation in the social sphere

     During the implementation of the Program, efforts will be coordinated to develop mutually beneficial cooperation in the field of healthcare and improving the sanitary and epidemiological situation, the production of medicines and medical equipment, culture and art, physical education, sports, sanatorium and tourism, labor protection, as well as in the field of training highly qualified personnel for various industries and exchange specialists, scientists, graduate students, interns, and students.

Cooperation in the field of environmental protection and rational use of natural resources

     Cooperation will be further developed in the field of harmonization of environmental legislation, regulatory regulation of environmental protection and environmental management, environmental impact assessment, production of environmental pollution control equipment and devices, improvement of the economic mechanism of environmental management, development and implementation of environmentally friendly resource-saving technologies, provision of mutual access in this area and in other areas.

Program implementation mechanism

     The Program will be implemented through the implementation by government agencies and business entities of the Republic of Kazakhstan and Ukraine of specific actions defined in this Program and Measures for its implementation.      Coordination and monitoring of the implementation of the Program and Activities will be carried out by the joint Interstate Kazakh-Ukrainian Commission for Economic Cooperation.
