Decree of the President of the Republic of Kazakhstan dated March 13, 2017 No. 437

In order to implement the Law of the Republic of Kazakhstan dated March 10, 2017 "On Amendments and Additions to the Constitution of the Republic of Kazakhstan", I HEREBY DECREE:

1. Central and local government bodies at all levels and local self-government bodies should take all necessary measures to ensure the smooth functioning of the State apparatus in the context of the expanded scope of powers and responsibilities of Parliament, the Government and other government bodies.

2. To recommend to the Parliament of the Republic of Kazakhstan to take measures to ensure the activities of the Parliament and its Chambers in accordance with the requirements of the Law of the Republic of Kazakhstan dated March 10, 2017 "On Amendments and Additions to the Constitution of the Republic of Kazakhstan" (hereinafter – the Law).

3. The Government of the Republic of Kazakhstan should promptly analyze and assess the functional readiness of central and local executive bodies to work with additional powers and take measures to ensure the effective functioning of the system of executive bodies in the new organizational and legal conditions.

To report the results of this work to the President of the Republic of Kazakhstan.

4. To determine that, in accordance with the legislative initiative of the President of the Republic of Kazakhstan, the following amendments will be submitted for consideration by the Mazhilis of the Parliament of the Republic of Kazakhstan:

1) a draft Constitutional Law providing for bringing into line with the Law the constitutional laws of the Republic of Kazakhstan "On the President of the Republic of Kazakhstan", "On the First President of the Republic of Kazakhstan – Leader of the Nation", "On the Parliament of the Republic of Kazakhstan and the status of its deputies", "On the Government of the Republic of Kazakhstan", "On the Constitutional Council of the Republic of Kazakhstan", "On the judicial system and the status of judges of the Republic of Kazakhstan", "On elections in the Republic of Kazakhstan", "On the Republican referendum";

2) the draft of the new Law of the Republic of Kazakhstan "On the Prosecutor's Office".

5. The Administration of the President of the Republic of Kazakhstan in cooperation with interested government agencies:

1) ensure the development and submission to the President of the Republic of Kazakhstan of draft legislative acts provided for in paragraph 4 of this Decree;

2) take measures to bring the current acts of the President of the Republic of Kazakhstan in line with the Law.

6. To the Government of the Republic of Kazakhstan within two months:

1) take measures to ensure that other legislative acts are brought into line with the Law;

2) ensure that the acts of the Government, central and local executive bodies, as well as maslikhats are reviewed and brought into line with the Law.

7. The Constitutional Council, the Supreme Court, the Central Election Commission of the Republic of Kazakhstan, as well as state bodies directly subordinate and accountable to the President of the Republic of Kazakhstan, should take measures to review and bring their adopted normative legal acts into line with the Law.

8. The Ministry of Foreign Affairs of the Republic of Kazakhstan should ensure that Kazakhstan's foreign and international partners receive information about the essence and content of the changes made in the country's state structure in accordance with the constitutional reform.

9. The Administration of the President of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan shall take other measures to implement this Decree.

10. Control over the implementation of this Decree is entrusted to the Administration of the President of the Republic of Kazakhstan.

11. This Decree comes into effect from the date of signing.
