MEDIATION AGREEMENT

 

Karaganda, May 30, 2023

 

Citizen A.J.B. /////////// year of birth, IIN: /////////// hereinafter referred to as the "Plaintiff", on the one hand, and

Citizen A.G.S. ////////// year of birth, IIN /////////// hereinafter referred to as the "Defendant" on the other hand, collectively referred to as the "Parties", have entered into this mediation agreement as follows:

The parties have agreed to conclude a mediation procedure in a dispute over the dissolution of marriage in accordance with the Law of the Republic of Kazakhstan "On Mediation" and the Civil Code of the Republic of Kazakhstan.

The parties confirm that the information provided by them in the mediation procedure is reliable.

This agreement is subject to execution based on the principles of voluntariness and good faith.

The content of the agreements and the terms of their execution:

4.1. The defendant A.G.S. recognizes the claims of A.Zh.B. for the dissolution of the marriage concluded on 08/27/2019 in the department of the Civil Registry Office of the akim of the Kazybek bi district of the city of Karaganda, record number 50-617-19-0002020.

4.2. The parties determined the place of residence of the minor children: B. N. Zh. 04.02.2007 year of birth, A.M. Zh.05.06.2017 year of birth, B. D. Zh. ////// year of birth, B.A.Zh. 20.09.2020 year of birth with the Defendant – A.G.S.

4.3. Plaintiff A.Zh.B. undertakes to pay monthly alimony payments in the amount of 1/2 of earnings and (or) other type of income for the maintenance of joint minor children: B.N.Zh. 04.02.2007 year of birth, A.M.Zh. 05.06.2017 year of birth, B.D. Zh. 10.03.2009 year of birth, B.A.Zh. 20.09.2020 year of birth from the date of conclusion this Agreement and until reaching the age of majority.

4.4. The parties have determined a half share each in jointly acquired real estate in the form of a two-room apartment located at the address: Karaganda, MD. ........., building 2/3, sq.30.

4.5. Plaintiff A.Zh.B. undertakes to transfer his 1/2 share in the apartment located at: Karaganda, mkr. ......., 2/3, sq.30 to the ownership of Defendant A.G.S. within five working days after making the last payment under the Bank Loan Agreement No.ML_000743206 from 08.11.2019.

4.6. The Parties determined a half share of each in the joint loan obligation to JSC Halyk Bank of Kazakhstan under the Bank Loan Agreement No.ML_000743206 dated 11/08/2019 in the amount of KZT 6,907,915 (six million nine hundred seven thousand nine hundred fifteen) 22 tiyn, the monthly payment is KZT 110,187 (one hundred ten thousand one hundred eighty-seven) 46 tiyn.

4.7. The defendant A.G.S. undertakes to transfer monthly funds to the Plaintiff A.J.B. in the amount of 55,093 (fifty-five thousand ninety-three) TENGE 73 tiyn to repay the monthly payment under the Bank Loan Agreement No. ML_000743206 dated 11/08/2019.

4.8. The plaintiff waives the claims for the dissolution of the marriage.

4.9. The Parties confirm that after the fulfillment of this Agreement, they will not have mutual claims against each other in the future regarding the division of common joint property and the maintenance of minor children.

The consequences of concluding a mediation agreement were explained to the parties.

This Agreement comes into legal force from the date of signing by the Parties.

The state fee paid by the Plaintiff of the civil case is subject to refund.
