Article 9. The procedure for the operation of the right-of-way of highways of the Law on Highways

     1. The lands of the right-of-way of public roads are owned and used by road authorities or other persons and are intended only for the development, improvement of highways and ensuring their safety.

     2. The construction of buildings and structures, as well as the laying of engineering communications within the right-of-way along a public highway, is prohibited, with the exception of road service facilities, outdoor (visual) advertising, police posts, sanitary and epidemiological control, customs, border, transport control, veterinary and phytosanitary control posts, antenna-mast structures and (or) supports for cellular or satellite communication equipment, fiber-optic communication lines, automated measuring stations.

     During the reconstruction of public roads of international, national, regional and district significance, the owners of antenna-mast structures and (or) supports for cellular or satellite communications equipment, fiber-optic communication lines, ensure their transfer at their own expense.

     3. Land plots of the right-of-way for public roads may be provided for temporary long-term land use in accordance with the procedure established by the legislation of the Republic of Kazakhstan for the placement of outdoor (visual) advertising facilities under conditions of preventing a decrease in the transport and operational qualities of the road, compliance with the requirements of vehicle safety and environmental protection.

      This Law regulates the legal, organizational and economic foundations of the state management of highways in the Republic of Kazakhstan, their construction, operation and development in the interests of the state and users of highways.
