Article 9. Requirements for environmental safety and environmental protection of the Law on Architectural, Urban Planning and Construction Activities in the Republic of Kazakhstan
1. Architectural, urban planning and construction activities should be carried out taking into account the assessment of its impact on the environment in accordance with the classification of facilities established by the Environmental Code of the Republic of Kazakhstan, and include measures for the rational use of natural resources, ensuring environmental safety and environmental protection.
These measures are envisaged and implemented in accordance with the standards and (or) the maximum permissible level (load) established by law for this type of impact.
2. The urban planning and architectural and construction documentation includes sections (parts) of projects on environmental protection and rational use of natural resources.
Compliance with the requirements (conditions, restrictions) of the project documentation approved in accordance with the established procedure for the rational use of natural resources, ensuring environmental safety and environmental protection is mandatory for all subjects of architectural, urban planning and construction activities implementing projects.
Territories with industrial centers or individual production complexes that have been declared environmental disaster zones should be provided with comprehensive design documentation to protect the population and the environment.
3. Integrated schemes of urban development of territories, interregional schemes of territorial development should provide for measures for environmental protection and environmental management, as well as rehabilitation of zones of environmental disasters and emergencies.
Draft general plans of settlements, detailed planning projects and other urban planning documentation should contain information about the water protection zones and strips of surface water bodies, specially protected natural territories available on the planned territory, indicating the availability of project approvals with the relevant authorized bodies in accordance with the procedure established by the legislation of the Republic of Kazakhstan.
In the absence of established water protection zones and strips of surface water bodies for the planned territory, the task for the development of these urban development projects should provide for the mandatory provision of a special section on the establishment of boundaries of water protection zones and strips of surface water bodies.
4. If there is a threat to human life and health in the territory that has previously arisen or is expected (predicted) as a result of contamination of the territory and/or facility with harmful chemical or biological substances in excess of the maximum permissible concentrations, or radioactive substances in excess of the maximum permissible levels, urban planning documentation should contain special sections (parts) of the project providing for measures to destroy (remove)) of such sources, conservation of polluted territories (facilities) with a set of measures for their rehabilitation, as well as the possibility for the Government of the Republic of Kazakhstan to introduce a special regime for the use of the territory or facility(s), including the temporary presence of citizens (population) in a disadvantaged area.

This Law regulates the relations that arise between government agencies, individuals and legal entities in the process of carrying out architectural, urban planning and construction activities in the Republic of Kazakhstan, and is aimed at creating a full-fledged human habitat and vital activity, sustainable development of settlements and interuniverse territories.
