Article 9. Powers of the President of the Republic of Kazakhstan during the period of martial law The Law On Martial Law
1. The President of the Republic of Kazakhstan during the period of martial law:
1) forms the Headquarters of the Supreme High Command of the Armed Forces of the Republic of Kazakhstan, carries out general management of the organization of ensuring martial law;
2) approves the regulations on the Headquarters of the Supreme High Command of the Armed Forces of the Republic of Kazakhstan;
3) approves the regulations on the defense councils of regions, cities of republican significance, and the capital;
4) approves the regulations on the organization of activities of the Government of the Republic of Kazakhstan during the period of martial law;
5) approves regulations on government agencies directly subordinate and accountable to him for the period of martial law;
6) ensures the coordinated functioning and interaction of state bodies;
7) approves the procedure for the application of martial law measures, as well as the powers of state bodies to ensure these measures;
8) issues regulatory legal acts on martial law issues;
9) adopt and introduce an emergency state budget in accordance with the laws of the Republic of Kazakhstan and immediately inform the Parliament of the Republic of Kazakhstan about it.;
10) establishes the procedure for the use of the Armed Forces, other troops and military formations, and state bodies to ensure martial law and determines their tasks in accordance with this Law;
11) establishes prohibitions or restrictions on the organization and conduct of peaceful assemblies, strikes;
12) determines the specifics of military service;
13) establishes a special mode of operation for transport, communications and energy, as well as facilities that pose an increased danger to human life, health and the environment.;
14) form consultative and advisory bodies on defense and security issues;
15) on the proposal of the Prime Minister of the Republic of Kazakhstan, determines the structure of the Government of the Republic of Kazakhstan for the period of martial law;
16) exercise other powers in accordance with the Constitution and laws of the Republic of Kazakhstan.
2. Provisions of the sub-paragraphs 2), 3), 4), 5), 7), 8) and 10) of paragraph 1 of this Article may be implemented both during the period of martial law and before its introduction.
The Law of the Republic of Kazakhstan dated March 5, 2003 No. 391.
This Law regulates the legal relations of citizens of the Republic of Kazakhstan, foreigners and stateless persons residing in the territory of the Republic of Kazakhstan (hereinafter referred to as citizens and other persons), as well as state bodies, military administration bodies and organizations, regardless of their forms of ownership (hereinafter referred to as organizations) during the period of martial law.
This Law is limited to the period of martial law.
