Article 9. Contract of the Law On Special State Bodies of the Republic of Kazakhstan

Article 9. Contract of the Law On Special State Bodies of the Republic of Kazakhstan

 

     1. The contract is concluded by a citizen of the Republic of Kazakhstan with an authorized head.

     2. The contract is voluntarily concluded in writing between the two parties in accordance with the legislation of the Republic of Kazakhstan and is terminated.:

     1) after the expiration date;

     2) in connection with the early dismissal of an employee;

     3) from the date of conclusion of another contract by the employee;

     4) in other cases established by the laws of the Republic of Kazakhstan.

     3. The contract stipulates the voluntary nature of a citizen's admission to service, the period during which a citizen undertakes to serve, and other terms of the contract.

     4. The terms of the contract include the obligation of a citizen to serve in special government agencies during the period specified in the contract. The terms of the contract contain norms providing for the observance of his rights, including receiving benefits, guarantees and compensations established by the legislation of the Republic of Kazakhstan.

     5. Employees appointed by the President of the Republic of Kazakhstan serve in the relevant position without entering into a contract.

     After these employees are dismissed from their posts, they enter into a new contract or resign from the service.

     6. The form of the contract, the procedure for its conclusion, extension, modification, termination and termination are determined by this Law and regulatory legal acts of special state bodies.

      7. A contract can be concluded:  

      1) for three years;  

      2) for five years;  

      3) for ten years;  

      4) before reaching the age limit of service status;  

      5) for cadets and trainees – for the duration of their studies at a military, special educational institution or educational organization of a foreign state and ten years of service in calendar terms after his (her) graduation;  

      6) for employees who have studied under postgraduate education programs – for the duration of their studies at a military, special educational institution or educational organization of a foreign state and five years of service in calendar terms after his (her) graduation.  

     If the current contract expires while an employee is on leave due to pregnancy and the birth of a child (children), adoption of a newborn child (children), or on leave without pay to care for a child until the age of three, the employee enters into a new contract within two months after leaving the leave. he is contracted or dismissed from the service in accordance with the procedure established by this Law.

 

 

The Law of the Republic of Kazakhstan dated February 13, 2012 No. 552-IV.

This Law defines the status of special state bodies of the Republic of Kazakhstan (hereinafter referred to as special state bodies), regulates public relations related to admission to service in special state bodies, its passage and termination, and also defines the legal status, financial support and social protection of employees of special state bodies.
