Article 8. The use of weapons, military equipment, special means, as well as physical force in ensuring martial law The Law On Martial Law
1. In the performance of their official duties, military personnel and employees of State bodies involved in ensuring martial law are granted the right to carry, store, use weapons, military equipment, special means, as well as the use of physical force.
These persons are not responsible for causing harm in connection with the use of physical force, special means, weapons and military equipment, if the harm caused corresponds to the nature and degree of the threatening danger.
2. Military personnel and employees of government agencies involved in ensuring martial law have the right to use physical force, special means, weapons or military equipment.:
1) to repel attacks on government and military facilities, citizens and other persons;
2) to suppress resistance involving danger to the life and health of military personnel and employees of government agencies, as well as citizens and other persons;
3) to detain persons carrying weapons, ammunition, explosives, chemical or poisonous substances, in cases where they:
caught committing a crime;
they do not comply with the legal requirements of military personnel or government officials;
they prevent military personnel and employees of state bodies from carrying out their official duties;
4) to prevent attempts of illegal entry into protected facilities and places of deployment of troops;
5) for the release of hostages, seized protected facilities, structures, vehicles and cargo, as well as for the suppression of mass riots and group violations of public order;
6) to stop a vehicle whose driver has failed to comply with legal requirements;
7) To sound an alarm or call for help;
8) in other cases in accordance with the legislative acts of the Republic of Kazakhstan.
3. The use of physical force, special means, weapons and military equipment in excess of authority entails liability in accordance with the legislation of the Republic of Kazakhstan.
The Law of the Republic of Kazakhstan dated March 5, 2003 No. 391.
This Law regulates the legal relations of citizens of the Republic of Kazakhstan, foreigners and stateless persons residing in the territory of the Republic of Kazakhstan (hereinafter referred to as citizens and other persons), as well as state bodies, military administration bodies and organizations, regardless of their forms of ownership (hereinafter referred to as organizations) during the period of martial law.
This Law is limited to the period of martial law.
