Article 8. Roadside lanes of the Law On Highways
1. Roadside lanes are established to ensure the safety of the public and create conditions for the operation of highways, taking into account the requirements of road safety, as well as the possibility of their reconstruction, repair and maintenance, and the placement of road infrastructure facilities.
2. For international and national public roads, the width of the roadside lane on each side must be at least 50 meters, counting from the boundary of the right-of-way.
For public roads of regional and district significance, the width of the roadside lane on each side of the road must be at least 40 meters, counting from the boundary of the right-of-way.
3. It is prohibited to build buildings and structures in the roadside lane of a public highway, with the exception of road service and roadside service facilities. The construction of roadside service facilities is carried out in accordance with national standards.
4. Decisions on the provision of land plots for the placement of roadside service facilities in roadside lanes or facilities beyond them, when access to them requires access, are made by the relevant local executive body in accordance with the established procedure in coordination with the National Operator.
The approval procedure is determined by the standard building rules approved in accordance with the legislation of the Republic of Kazakhstan on architectural, urban planning and construction activities.
5. The costs of arranging, repairing and maintaining entrances (exits, junctions) and other facilities located in the roadside lanes of public roads are borne by the owners of these facilities.

This Law regulates the legal, organizational and economic foundations of the state management of highways in the Republic of Kazakhstan, their construction, operation and development in the interests of the state and users of highways.
