Article 8. Rights of State plant protection inspectors of the Law on Plant Protection
1. State plant protection inspectors have the right to:
1) for the purpose of state phytosanitary control, visit the facilities of the state state phytosanitary control;
2) issue instructions to individuals and legal entities on the elimination of identified violations of the legislation of the Republic of Kazakhstan on plant protection;
3) suspend or prohibit activities or certain types of activities without a court decision in the cases provided for in Article 48 of the Code of the Republic of Kazakhstan on Administrative Offenses, with mandatory presentation of materials on the case of an administrative offense to the court within three days. In this case, the act of prohibition or suspension of activities is valid until a court decision is rendered.;
4) to bring individuals and legal entities to administrative responsibility in case of violation of the legislation of the Republic of Kazakhstan on plant protection in accordance with the laws of the Republic of Kazakhstan.
2. The actions of state plant protection inspectors may be appealed in accordance with the procedure established by the legislation of the Republic of Kazakhstan.
The Law of the Republic of Kazakhstan dated July 3, 2002 No. 331.
This Law defines the legal, economic and organizational bases for carrying out activities in the field of plant protection from pests, weeds and plant diseases and is aimed at preserving crops, their quality and preventing harmful effects on human health and the environment when implementing phytosanitary measures in the territory of the Republic of Kazakhstan.
