Article 8. Restrictions on the rights of military personnel related to military service The Law on Military Service and the Status of Military Personnel

1. A serviceman may not:

     1) to be a deputy of representative bodies and a member of local self-government bodies, to be a member of political parties, trade unions, religious associations, to speak in support of any political party;

     2) engage in other paid activities, except for medical, pedagogical, scientific and other creative activities that do not interfere with the performance of military service duties;

3) engage in entrepreneurial activity;

3-1) participate in the management of a commercial or non-profit organization, except in cases where this is his official duties in accordance with the legislation of the Republic of Kazakhstan or is necessary for the management of shares specified in subparagraph 3-2) of this paragraph, or is participation on a gratuitous basis in the management of a consumer or housing and construction cooperative;

     3-2) acquire securities, except for the acquisition and (or) sale, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, of shares of open and interval mutual funds, bonds, shares of commercial organizations (common shares in the amount not exceeding five percent of the total number of voting shares of organizations);

     4) be a representative in matters of third parties, except in cases provided for by law;

     5) to use military property and other means of ensuring its official activity, other state property and official information for non-official purposes;

     6) organize and participate in strikes, picketing and other protest actions;

     7) to use his official position for personal gain, including by collusion with officials and other persons;

     8) hold a position directly subordinate to the position held by his close relatives (parents, children, adoptive parents, adopted children, full- and half-siblings, grandfathers, grandmothers, grandchildren), spouse and (or) relatives (full- and half-siblings brothers and sisters, parents and children of the spouse, as well as have close relatives, spouse and (or) relatives directly subordinate to them.;

      9) refuse or evade medical examination in medical organizations to establish the fact of using a psychoactive substance and intoxication at the direction of an authorized supervisor.  

     Refusal or evasion from passing an examination entails dismissal from military service.

2. Anti-corruption restrictions imposed by military personnel are established by this Law and the Law of the Republic of Kazakhstan "On Combating Corruption".

     Anti-corruption restrictions imposed by political civil servants are established by this Law and other laws of the Republic of Kazakhstan.

     3. Responsibility for non-compliance with the restrictions provided for in this article is established by this Law and other laws of the Republic of Kazakhstan.

 

The Law of the Republic of Kazakhstan dated February 16, 2012 No. 561-IV SAM.

     This Law regulates public relations in the field of military service by citizens of the Republic of Kazakhstan and defines the foundations of the state policy on social security for military personnel.
