Article 8. Requirements for the implementation of credit rating activities of the Law of the Republic of Kazakhstan On Credit Rating Activities

     1. Credit rating agencies adhere to the basic principles of regulating credit rating activities specified in Article 3 of this Law.

     At the same time, employees of the credit rating agency must comply with the norms of the code of conduct approved by the Board of directors of the credit rating agency.

     2. Credit rating agencies ensure the adoption and compliance of internal policies, procedures and internal controls aimed at preventing the assignment of an unreliable credit rating.

     3. It is not allowed to delay or refuse to carry out and publish a rating action based on the potential impact (economic, political or otherwise) of such action on the credit rating agency, the rated person or any other person or organization directly or indirectly related to the rated person, with the exception of a non-public rating.

     4. A credit rating agency ensures the availability of labor, material and financial resources to carry out credit rating activities.

     5. The types of ratings assigned by a credit rating agency are subject to the availability of methodology, procedures, necessary information, experience and knowledge from employees involved in credit rating activities, and internal control personnel.

     6. It is prohibited to influence credit rating activities and the content of methodologies used by credit rating agencies, unless otherwise provided by the laws of the Republic of Kazakhstan.

     7. A credit rating agency may apply a national and/or international rating scale when developing and applying methodologies.

     The International Rating Scale is a rating scale that provides an international comparison of credit ratings assigned by credit rating agencies.

     The national rating scale is a rating scale that provides a comparison of exclusively domestic credit ratings assigned by credit rating agencies.
