Article 8-5. Forbidden swimming areas and temporarily dangerous swimming areas The Merchant Shipping Act

     1. In order to ensure the conduct of exercises, the protection of the state interests of the Republic of Kazakhstan and the protection of the environment, as well as during anti-terrorist operations and security measures in internal and territorial waters, areas prohibited for navigation and temporarily dangerous for navigation areas restricted for swimming, anchoring, extraction of marine mammals, fishing with bottom mining tools may be established. (fishing) of aquatic biological resources, underwater explosions, swimming with an etched anchor chain, overflight, hovering and landing (landing) of aircraft and other activities.

      2. All vessels and floating facilities are prohibited from sailing in restricted areas. The decision on the establishment of forbidden swimming areas and their opening for swimming is made by the Ministry of Defense of the Republic of Kazakhstan on the recommendation of interested government agencies and organizations.  

      The decision to establish areas prohibited for swimming during an anti–terrorist operation and to open them for swimming is made by the head of the republican operational headquarters, and during security measures - by the head of the State Security Service of the Republic of Kazakhstan.  

     3. Temporarily dangerous areas for navigation are set for a certain period of time. The decision to establish temporarily dangerous areas for navigation is made by the Ministry of Defense of the Republic of Kazakhstan. The said decision shall enter into force upon the expiration of ten calendar days from the date of notification of the concerned state bodies.

     This Law defines the legal, organizational, economic and international foundations of public administration in the field of merchant shipping and regulates relations related to the transportation of passengers, baggage and cargo, ensuring safety in maritime transport and environmental protection.
