Article 7. The rights and duties of a bailiff of the Bailiff Act

Article 7. The rights and duties of a bailiff of the Bailiff Act

      1. In order to perform the tasks assigned to him, the bailiff has the right:  

      1) require citizens to comply with the established procedure for the court's activities, as well as to stop illegal actions in the courtroom and in the courtroom;  

     1-1) is excluded by the Law of the Republic of Kazakhstan dated 26.06.2020 No. 349-VI (effective after ten calendar days after the date of its first official publication);  

      2) to carry out administrative detention of the offender in the courthouse (in the case of an off-site meeting - in the room where the court session is being held).;  

      3) to draw up a protocol on the offense in order to bring it to justice in accordance with the procedure established by law;  

      4) to deliver the offender to the internal affairs bodies;  

      5) use firearms and electric weapons, special means and physical force in accordance with the procedure provided for by the legislation of the Republic of Kazakhstan.  

      2. The bailiff is obliged to:  

      1) to use the rights granted to him in strict accordance with the law and not to allow infringement of the rights and legitimate interests of citizens and legal entities in his activities;  

      2) to protect judges and other persons participating in the judicial process;  

      3) ensure the protection of conference rooms, other judicial premises and buildings;  

     4) excluded by the Law of the Republic of Kazakhstan dated 26.06.2020 No. 349-VI (effective ten calendar days after the date of its first official publication);  

      5) to prevent and suppress offenses in the courtroom and courtroom;  

      6) to ensure, on the instructions of the judge, the delivery of the criminal case and material evidence and their safety during the trial outside the place of permanent residence of the court;  

      7) to carry out the judge's orders related to the observance of the procedure for conducting court proceedings;  

      8) to bring persons who evade appearing in court;  

     9) to interact with the staff of the convoy service on issues of safety and security of persons in custody.
