When performing the tasks of operational investigative activity defined by this Law, the bodies authorized to carry it out are obliged to:

a) take the necessary measures, in accordance with their competence, to protect the legally protected rights, freedoms and interests of individuals and legal entities, property, the security of society, the state and strengthen its economic and defense potential;

b) to ensure the detection, prevention and suppression of crimes by carrying out operational search measures and secret investigative actions, recording their results for use in criminal proceedings, and executing written instructions from the investigator on conducting operational search measures in criminal cases under investigation.;

b-1) to comply with the written instructions of the prosecutor, given in the course of supervision of the legality of operational investigative activities;

b-2) execute judicial acts on the search for a fugitive criminal defendant and a defendant in civil cases, a person evading serving a sentence or probation control, as well as decisions of bailiffs authorized by the prosecutor on the search for a debtor in enforcement proceedings;

c) promptly inform the state authorities and management bodies of the Republic of Kazakhstan about the facts and data known to them, indicating a threat to the security of society and the state;

d) comply with requests from relevant international law enforcement organizations and law enforcement agencies of foreign States on the basis of agreements (agreements) on legal assistance;

e) take the necessary measures to ensure secrecy during operational search activities and covert investigative actions, as well as when transmitting materials reflecting the results of operational search activities and covert investigative actions, for use in criminal proceedings and to prevent the declassification of information sources.

The Law of the Republic of Kazakhstan dated September 15, 1994 No. 154-XIII.

This Law defines the content of operational investigative activities carried out on the territory of the Republic of Kazakhstan and establishes a system of legal guarantees of legality in its conduct.
