Article 6. Competence of the authorized body of the Law On Plant Protection
The competence of the authorized body includes:
1) formation and implementation of the state policy in the field of plant protection;
2) development and approval, within its competence, of regulatory legal acts in the field of plant protection;
3) implementation of coordination and methodological guidance of local executive bodies in the field of plant protection;
4) development and approval of the list of especially dangerous harmful organisms;
5) development and approval of technical regulations on the safety of plant protection products (pesticides);
5-1) issuing an opinion (authorization document) for the import of samples of unregistered plant protection products (pesticides) for registration (small-scale and industrial) tests and (or) scientific research in accordance with the decisions of the Board of the Eurasian Economic Commission;
5-2) issuing a license for the import of plant protection products (pesticides);
5-3) development and approval of the procedure for conducting an investigation in the field of plant protection;
6) development and approval of qualification requirements for the following types of activities in:
production (formulation) of pesticides;
pesticide sales;
application of pesticides by aerosol and fumigation methods;
7) development and approval of rules for conducting registration (small-scale and industrial) tests and state registration of pesticides in coordination with the authorized body in the field of environmental protection and the state body in the field of sanitary and epidemiological welfare of the population;
8) state registration of pesticides and issuance of registration certificates for pesticides;
9) development, approval and maintenance of a list of pesticides;
10) development and approval of rules for conducting phytosanitary measures;
11) development and approval of the forms of protocols and regulations, as well as the procedure for their preparation and issuance in accordance with the legislation of the Republic of Kazakhstan;
12) organization of phytosanitary measures;
13) coordination of the activities of government agencies, individuals and legal entities in carrying out phytosanitary measures;
14) organization and conduct of public procurement of pesticides, works and services for their storage, transportation, use, as well as the creation of a stock of pesticides in accordance with the procedure established by the legislation of the Republic of Kazakhstan;
15) development and approval of phytosanitary standards, forms of phytosanitary accounting, as well as the procedure for their submission;
16) organization of phytosanitary monitoring of harmful and especially dangerous harmful organisms;
17) organization of registration (small-scale and industrial) tests and state registration of pesticides;
18) organization and coordination, execution of orders for applied scientific research in the field of plant protection;
19) distribution of pesticides purchased at the expense of budgetary funds across the territory of the Republic of Kazakhstan, depending on the data of phytosanitary monitoring and the prevailing phytosanitary situation;
20) cooperation with international organizations and government agencies and participation in the implementation of international programs in the field of plant protection;
21) establishment of a stock standard for the types of pesticides and the procedure for its use;
22) organization and implementation of state phytosanitary control;
22-1) consideration of draft standardization documents within the scope of competence, as well as preparation of proposals for the development, amendment, revision and cancellation of national, interstate standards, national classifiers of technical and economic information and recommendations on standardization for submission to the authorized body in the field of standardization;
23) monitoring compliance with the legislation of the Republic of Kazakhstan on plant protection by local executive bodies;
24) determining the procedure for the neutralization of pesticides, as well as the conditions for maintaining special storage facilities (burial grounds) in good condition in coordination with the authorized body in the field of environmental protection and the state body in the field of sanitary and epidemiological welfare of the population.;
25) approval of methods, techniques, recommendations regulating the procedure, methods of implementing phytosanitary measures, organization, coordination and control of applied scientific research in the field of plant protection, as well as coordination of training programs (training programs) for the training and advanced training of plant protection specialists;
26) excluded by the Law of the Republic of Kazakhstan dated December 29, 2014 No. 269-V (effective from 01.01.2015);
27) exercise of other powers provided for by the legislation of the Republic of Kazakhstan.
The Law of the Republic of Kazakhstan dated July 3, 2002 No. 331.
This Law defines the legal, economic and organizational bases for carrying out activities in the field of plant protection from pests, weeds and plant diseases and is aimed at preserving crops, their quality and preventing harmful effects on human health and the environment when implementing phytosanitary measures in the territory of the Republic of Kazakhstan.
