For registration of a branch (representative office), an application is submitted to the registration authority in the form established by the Ministry of Justice of the Republic of Kazakhstan. The application is signed by a person authorized by the legal entity establishing the branch (representative office) and sealed with the seal of the legal entity.

If the legal entity is a private business entity, the application does not need to be sealed.

The application must be accompanied by a document confirming payment to the budget of the registration fee for registration of a branch (representative office) of a legal entity that is a non-profit organization, or a document confirming payment to the Government for Citizens State Corporation for registration of a branch (representative Office) of a legal entity that is a commercial organization.

For branches (representative offices) of legal entities that are not private business entities, as well as joint-stock companies, the regulations on the branch (representative office) in electronic form in Kazakh and Russian languages, approved by the legal entity, copies of the charter (regulations) and the power of attorney of the legal entity (except for public and religious associations), issued to the head, are additionally submitted. branch (representative office).

The registration of branches (representative offices) of foreign legal entities is carried out in accordance with the procedure established by the legislative acts of the Republic of Kazakhstan for the registration of branches (representative offices) of legal entities of the Republic of Kazakhstan. In addition to the documents provided for in this procedure, unless otherwise established by international treaties ratified by the Republic of Kazakhstan, a legalized extract from the commercial register, constituent documents or other legalized document of a foreign legal entity confirming that the foreign legal entity establishing a branch (representative office) is a legal entity under the legislation of a foreign state, and also, a document confirming the tax registration in the country of incorporation of a foreign legal entity, indicating the tax registration number (or its equivalent). Documents of a foreign legal entity establishing a branch (representative office) are submitted with a notarized translation into Kazakh and Russian.

When establishing a branch (representative office) by a state-owned enterprise, a document confirming the consent of the National Bank of the Republic of Kazakhstan or the authorized state property management body (local executive body) to establish a branch (representative office) is additionally submitted.

For branches (representative offices) of joint-stock companies, the regulations on the branch (representative office) in Kazakh and Russian languages, approved by the legal entity, the charter (regulations) and the power of attorney of the legal entity issued to the head of the branch (representative office) are additionally attached.

When registering a branch of a foreign legal entity whose business is the provision of financial services, the National Register of Business Identification Numbers receives information about the availability of permission from the authorized body for regulation, control and supervision of the financial market and financial organizations through an electronic notification.

Registration of a branch (representative office) of a legal entity, with the exception of branches (representative offices) of political parties and religious associations, is carried out on the basis of an electronic application submitted through the e-government web portal, as well as other informatization facilities, in accordance with the procedure determined by the Ministry of Justice of the Republic of Kazakhstan.
