Article 5. The Law on the Revised Republican Budget for 1994
Establish that:
a) All enterprises, associations and organizations, regardless of their forms of ownership, that are economically settled (with the exception of loss-making enterprises, as well as enterprises with the involvement of foreign capital, whose share in the authorized capital is more than 30 percent, and involved in the development and extraction of minerals in accordance with agreements and contracts concluded with the Government of the Republic of Kazakhstan), make mandatory contributions to the economic transformation fund in the amount of 5 percent of the cost of production (works, services), with these amounts included in the cost. The funds of the Economic Transformation Fund are used to finance investments both on an irrevocable basis and on repayment terms as credit resources with interest, inflation-adjusted indexing, the amount of which is determined by the Cabinet of Ministers of the Republic of Kazakhstan, as well as for expenses determined by the Supreme Council of the Republic of Kazakhstan.
To make the following amendments and additions to the Law of the Republic of Kazakhstan dated April 12, 1993 "On the Fund for the Transformation of the Economy of the Republic of Kazakhstan" (Bulletin of the Supreme Council of the Republic of Kazakhstan, 1993, No. 9, Article 208):
Add the following words to the first part of Article 1 after the words "state fund": "as part of the republican budget";
After the words "enterprises and organizations", add the following words to Article 2: "(enterprises with the involvement of foreign capital, whose share in the authorized capital is less than 30 percent, and participating in the development and extraction of minerals in accordance with agreements and contracts concluded with the Government of the Republic of Kazakhstan);
After the word "special", add the word "budgetary" to article 4.;
from the second paragraph of the fifth part of Article 6, the words "and physical" should be deleted; the seventh part of Article 6 should be deleted;
delete the sixth paragraph of the second part of Article 8;
To make the following amendments and additions to the Law of the Republic of Kazakhstan dated April 12, 1993 "On the return system of Investment Financing" (Bulletin of the Supreme Council of the Republic of Kazakhstan, 1993, No. 9, art. 210):
After the word "special", add the word "budgetary" to the first part of Article 3, and replace the word "exclusively" with the words "mainly".
b) Enterprises, associations and organizations located on the territory of the Republic of Kazakhstan, regardless of their forms of ownership, make mandatory contributions to the Entrepreneurship Support and Competition Development Fund of the Republic of Kazakhstan in the amount of 1 percent of the profits remaining at their disposal after paying income tax.
c) Enterprises, associations and organizations of extractive industries make contributions to the Fund for the Protection of the Subsoil and the Reproduction of the Mineral Resource Base on the basis of rates approved by the Cabinet of Ministers of the Republic of Kazakhstan, as a percentage of the cost of raw materials sold.
d) The State Employment Assistance Fund of the Republic of Kazakhstan is formed at the expense of mandatory contributions from business entities-employers in the amount of 2 percent to the wage fund. Exempt institutions and organizations funded by the State budget, collective farms, state farms and other agricultural enterprises, regardless of their forms of ownership, that directly produce agricultural products, as well as enterprises of societies for the deaf, blind and disabled from contributions to the State Employment Assistance Fund.
The costs of resettlement activities are financed from the State Employment Assistance Fund.
In order to create and maintain existing jobs in accordance with paragraph 3 of the Decree of the President of the Republic of Kazakhstan dated September 6, 1993
No. 1344 "On the new Housing Policy" 15 percent of the employment fund's funds are allocated to finance the housing sector.
