Article 5-1. Making a decision on the use of a motorway (section) on a toll basis of the Law on Motorways  

      The footnote. Title of Article 5-1 as amended by the Law of the Republic of Kazakhstan dated 07/02/2013 No. 112-V (effective ten calendar days after its first official publication).

     1. Decisions on the use of motorways (sections) on a paid basis may be made in relation to:

     1) public roads (sections) of international and national significance of the I technical category for all types of motor transport;

     2) public roads (sections) of international and national significance of the II technical category for all types of motor transport or only for freight motor transport;

     3) public roads (sections) of international and national significance of the III technical category for trucks;

     4) streets of the capital and cities of national importance.

     2. The decision on the use of public roads of international and national importance on a paid basis is made by the authorized state body for highways.

      3. The decision on the use of a toll road must specify:  

      1) starting and ending points with the possibility of traveling along another existing alternative road;  

      2) a list of intersections with other highways and junctions to other highways;  

      3) Technical classification and main parameters;  

      4) length;  

     5) the fare rate;

      6) a list of adjacent settlements that do not have an alternative route on another highway;  

      7) the period of use is on a paid basis.  

      4. The decision on the use of a toll road must be published within thirty calendar days from the date of the decision in periodicals distributed throughout the Republic of Kazakhstan, in the state and Russian languages.

      This Law regulates the legal, organizational and economic foundations of the state management of highways in the Republic of Kazakhstan, their construction, operation and development in the interests of the state and users of highways.
