Article 40. Transfer of land use rights in the order of universal succession of the Land Code of the Republic of Kazakhstan
1. The transfer of the right of land use by universal succession means that the right of land use arises from the legal successor during inheritance by law or during the reorganization of a legal entity.
2. In the event of the death of a citizen to whom the land plot belongs on the right of long-term temporary land use, the right of land use is inherited in accordance with the procedure provided for by the civil legislation of the Republic of Kazakhstan. Unless otherwise provided by the temporary land use agreement, the right to temporary short-term land use is inherited in the same manner.
3. In case of reorganization of a legal entity, the right of land use belonging to it passes to the legal successor in accordance with the norms of the civil legislation of the Republic of Kazakhstan and this Code.
