Article 4. The right of ownership and other property rights to highways of the Law on Highways

     1. Highways may be owned by the state or privately owned.  

     2. Excluded by the Law of the Republic of Kazakhstan dated 09/29/2014 No. 239-V (effective ten calendar days after the date of its first official publication).

     2-1. Public roads or sections thereof may be transferred for the implementation of a public-private partnership project, including a concession, in accordance with the legislation of the Republic of Kazakhstan in the field of public-private partnership and on concessions.

     2-2. Public roads of regional or district significance or their sections may be provided for gratuitous temporary use to legal entities of the Republic of Kazakhstan (loan recipients) in accordance with the contract for the gratuitous use of public roads of regional or district significance or their sections.

     2-3. Republican public roads or their sections may be sold to the state Islamic special financial company on the basis of a decision of the Government of the Republic of Kazakhstan with the obligation to buy them back in accordance with the terms of the issue of state Islamic securities.

     3. Excluded by the Law of the Republic of Kazakhstan dated 09/29/2014 No. 239-V (effective ten calendar days after the date of its first official publication).  

     4. Private highways are the property of individuals and legal entities.  

     5. Streets of settlements are under the jurisdiction of the relevant local executive bodies and are communal property.  

     6. The privatization of commercial highways is carried out in accordance with the Law of the Republic of Kazakhstan "On State Property" and this Law.

     7. Public roads of international and national significance and road service facilities may be transferred to the National Operator for trust management for construction, reconstruction, and organization of toll traffic.

The Law of the Republic of Kazakhstan dated July 17, 2001 No. 245.

      This Law regulates the legal, organizational and economic foundations of the state management of highways in the Republic of Kazakhstan, their construction, operation and development in the interests of the state and users of highways.
