Article 4. The introduction of martial law Law on Martial Law
1. Cases of aggression against the Republic of Kazakhstan or an immediate external threat to its security are grounds for the introduction of martial law throughout the territory of the Republic of Kazakhstan or in its individual localities.
2. Martial law on the entire territory of the Republic of Kazakhstan or in its individual localities is introduced by decree of the President of the Republic of Kazakhstan.
3. Upon the introduction of martial law by the President of the Republic of Kazakhstan, partial or general mobilization is announced, if it has not been announced earlier.
4. The decree of the President of the Republic of Kazakhstan on the introduction of martial law defines:
the circumstances that served as the basis for the introduction of martial law;
list of imposed measures and temporary restrictions on the rights and freedoms of citizens and other persons;
the boundaries of the territory where martial law is imposed;
forces and means used to establish and maintain martial law;
the time when martial law begins to take effect.
5. The full text of the decree of the President of the Republic of Kazakhstan on the introduction of martial law is subject to immediate broadcast on radio and television, as well as official publication.
6. The President of the Republic of Kazakhstan shall immediately inform the Parliament of the Republic of Kazakhstan of the imposition of martial law and the announcement of partial or general mobilization.
7. The procedure for preparing the state to repel aggression is determined by the President of the Republic of Kazakhstan in accordance with the legislation of the Republic of Kazakhstan.
The Law of the Republic of Kazakhstan dated March 5, 2003 No. 391.
This Law regulates the legal relations of citizens of the Republic of Kazakhstan, foreigners and stateless persons residing in the territory of the Republic of Kazakhstan (hereinafter referred to as citizens and other persons), as well as state bodies, military administration bodies and organizations, regardless of their forms of ownership (hereinafter referred to as organizations) during the period of martial law.
This Law is limited to the period of martial law.
