The provision of land plots for the construction of individual residential buildings is regulated by the land and other legislation of the Republic of Kazakhstan.

The number of land plots reserved for allocation for individual housing construction, as well as the order of their development in a locality, are determined on the basis of relevant urban planning documentation and are regulated by the local executive body of the city of republican significance, capital, district (city of regional significance), based on the availability of land resources and the interests of integrated socio-economic development of the territory.

To obtain a land plot, an individual developer submits an application to the relevant local executive body of the city of republican significance, the capital, the district (city of regional significance), which has the right to provide land plots.

When accepting an application, it is prohibited to require documents and information from a citizen that are not provided for in the approved list.

For concealing information about the availability of land for the construction of individual residential buildings, its distortion, and unjustified refusal to provide land, executive officials bear administrative and other responsibilities established by the legislation of the Republic of Kazakhstan.

It is prohibited to provide citizens of the Republic of Kazakhstan with land plots for individual housing construction without special registration of their applications.

The Law of the Republic of Kazakhstan dated November 3, 1994 No. 213.

The purpose of this Law is to create a legal framework for regulating relations between the state, local executive bodies and citizens of the Republic of Kazakhstan who act as developers (owners) of individual residential buildings in order to implement the constitutional right to housing.
