Article 4. Citizens entitled to benefits The Law on the State Special Allowance for Persons who have Worked in Underground and Open-pit Mining, in Work with Particularly Harmful and Particularly Difficult Working Conditions, or in Work with Harmful and Difficult Working Conditions
1. Citizens who, as of January 1, 1998, had work experience in accordance with the List No. 1 of industries, jobs, professions, positions and indicators in underground and open-pit mining, in work with particularly harmful and particularly difficult working conditions, approved by the Government of the Republic of Kazakhstan, have the right to receive benefits.:
men - upon reaching the age of 53 and with at least 20 years of work experience, including at least 10 years in these jobs;
women - upon reaching the age of 48 and with at least 15 years of work experience, including at least 7 years and 6 months in these jobs.
2. Citizens who, as of January 1, 1998, had work experience in accordance with the List No. 2 of industries, jobs, professions, positions and indicators with harmful and difficult working conditions, approved by the Government of the Republic of Kazakhstan, have the right to receive benefits.:
men - upon reaching the age of 58 and with at least 25 years of work experience, of which at least 12 years and 6 months in these jobs;
women - upon reaching the age of 53 and with at least 20 years of work experience, including at least 10 years in these jobs.
2-1. Work experience is calculated in accordance with the Social Code of the Republic of Kazakhstan.
3. If the length of service required by this Law is insufficient in accordance with List No. 2 of industries, jobs, professions, positions and indicators for jobs with harmful and severe working conditions, the length of service in accordance with List No. 1 of industries, jobs, professions, positions and indicators for underground and open-pit mining, especially harmful and especially severe working conditions.
4. The right to benefits does not apply to citizens who retired on preferential terms before January 1, 1998.
The Law of the Republic of Kazakhstan dated July 13, 1999 No. 414.
This Law is aimed at the social protection of citizens who, as of January 1, 1998, had the experience established by this Law in underground and open-pit mining, in work with particularly harmful and particularly difficult working conditions, or in work with harmful and difficult working conditions.
