Article 4. Authorized state body in the field of protection of inventions, utility models, industrial designs of the Patent Law of the Republic of Kazakhstan

1. The authorized state body in the field of protection of inventions, utility models, and industrial designs (hereinafter referred to as the authorized body) is a state body designated by the Government of the Republic of Kazakhstan and carrying out state regulation in the field of protection of inventions, utility models, and industrial designs.

2. The competence of the authorized body includes:

1) participation in the implementation of state policy in the field of legal protection of industrial property;

2) Development and approval:

rules for the examination of applications for industrial property;

rules for registration of industrial property objects in the State Register of Inventions, the State Register of Utility Models, the State Register of Industrial Designs and the issuance of security documents and their duplicates, invalidation and early termination of patents;

rules for registration in the relevant state registers of the transfer of an exclusive right, the granting of the right to use an object of industrial property, an open or compulsory license;

rules for providing extracts from relevant state registers;

rules for consideration of objections by the Board of Appeal;

rules for consideration of applications for industrial property objects in accordance with international treaties ratified by the Republic of Kazakhstan;

Regulations on the Attestation Commission;

Regulations on the Board of Appeal;

Regulations on the Appeals Commission;

3) determination of the procedure for publication in the bulletin of information related to the registration of industrial property;

4) attestation of persons applying to engage in the activities of a patent attorney, their registration in the register of patent attorneys, exclusion from the register of patent attorneys, invalidation of the certificate of a patent attorney and cancellation of information in the register of patent attorneys;

5) organization of the activities of the attestation Commission, the Board of Appeal and the Appeals Commission;

6) exercise of other powers provided for by this Law, other laws of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan.
