Article 4-1. Provision of public roads of regional or district significance for gratuitous temporary use of the Law on Highways
1. The decision to provide public roads of regional or district significance or their sections for gratuitous temporary use is made, respectively, by the local executive body of the region or district (the lender) on the basis of the application of the borrower.
2. The right of gratuitous temporary use of public roads of regional or district significance or their sections is granted for a period of up to five years. The borrower, who has duly performed his duties, has, upon the expiration of the contract, all other things being equal, a preferential right over other persons to conclude a contract for a new term.
3. In accordance with the contract for the gratuitous use of public roads of regional or district significance or their sections, the borrower is obliged to:
1) to maintain the specified highways in a technically sound condition and to carry out repairs in accordance with the requirements of the legislation of the Republic of Kazakhstan;
2) comply with the general safety requirements at your own expense;
3) to ensure safe, unhindered, free passage with an acceptable speed limit for vehicles throughout its entire length.
4. The reconstruction and repair of public roads of regional or district significance is allowed with a permit issued by the local executive body of the region or district, with the consent of the authorized body for road safety.
5. The provision of public roads of regional or district significance or their sections for gratuitous temporary use is formalized on the basis of a standard agreement approved by the authorized state body for highways.
