Article 382. Definition of the terms of the contract of the Civil Code of the Republic of Kazakhstan
1. The terms of the agreement are determined at the discretion of the parties, except in cases where the content of the relevant terms is prescribed by law.
In cases where the condition of the contract is provided for by a norm that, in accordance with the law, is in force, unless otherwise established by agreement of the parties (a dispositive norm), the parties may, by their agreement, exclude its application or establish a condition other than that provided for in it. In the absence of such an agreement, the terms of the contract are determined by the dispositive norm.
2. If the terms of the contract are not defined by the parties or the dispositive norm, the relevant terms are determined by the business practices applicable to the relations of the parties.
