Article 38. Return of a ship's crew member to the place of employment The Law on Inland Waterway Transport
1. The owner of the vessel and (or) the shipowner are obliged to ensure the return of the ship's crew member and his personal property weighing up to thirty kilograms to the place of employment of the ship's crew member or to another place agreed by the parties at their own expense in the event:
1) shipwreck;
2) illness of a ship's crew member or injury requiring treatment outside the ship;
3) termination of the employment contract in accordance with the labor legislation of the Republic of Kazakhstan, including the expiration outside the Republic of Kazakhstan of the term of the employment contract concluded for a certain period;
4) the inability of the shipowner and (or) the shipowner to fulfill their duties with respect to the ship's crew members provided for by the legislation of the Republic of Kazakhstan or labor and collective agreements, as a result of the bankruptcy of the shipowner, the sale of the vessel or a change in the state of registration of the vessel;
5) sending a vessel without the consent of a ship's crew member to a war zone or an epidemiological danger zone.
2. If the reason for the return of the ship's crew members to the place of employment is their violation of the terms of the labor and collective agreements, the ship owner and (or) the shipowner has the right to recover from these crew members the costs associated with such return, in whole or in part, in accordance with the legislation of the Republic of Kazakhstan, labor and collective agreements.

This Law regulates public relations that arise between government agencies, individuals and legal entities in the field of inland waterway transport during navigation, transportation of passengers, baggage and cargo, operation of small vessels, including on bodies of water not related to inland waterways and sea waters, and also defines their rights, duties and responsibilities..
