Article 370-2. Refusal or evasion by an employee of a law enforcement agency or a special government agency from fulfilling the duties of the service of the Criminal Code of the Republic of Kazakhstan, the Criminal Code of the Republic of Kazakhstan
1 The refusal of an employee of a law enforcement or special state body to execute an order given in accordance with the established procedure, which caused significant harm to the interests of the service, as well as the evasion of an employee of a law enforcement or special state body from performing the duties of the service, committed by feigning illness or causing any damage to himself (self-harm) or other harm to his health, or forgery of documents, or other deception that caused significant harm to the interests of the service, –
are punishable by a fine in the amount of up to one hundred and twenty monthly calculation indices, or correctional labor in the same amount, or arrest for up to thirty days.
2 The acts provided for in the first part of this Article:
1) committed in an emergency situation or mass riots;
2) related to ensuring the safety of protected persons or facilities, –
are punishable by restriction of liberty for a term of up to six years or imprisonment for the same term.
3 The acts provided for in the first part of this Article, committed under conditions of emergency or martial law or entailing grave consequences, –
are punishable by imprisonment for a term of three to ten years.
