Article 335. Illegal extraction of fish resources, other aquatic animals or plants of the Criminal Code of the Republic of Kazakhstan, the Criminal Code of the Republic of Kazakhstan

1 Illegal extraction of fish resources, other aquatic animals or plants, if this act is committed:

     1) causing significant damage;

     2) using explosives or chemicals, electric current or other methods of mass destruction of fish resources and other aquatic animals and plants, –

     is punishable by a fine in the amount of up to three thousand monthly calculation indices, or correctional labor in the same amount, or community service for up to eight hundred hours, or restriction of liberty for up to three years, or imprisonment for the same period, with confiscation of property, with deprivation of the right to hold certain positions or engage in certain activities. for a period of up to five years.

2 The same act committed repeatedly, –

     is punishable by a fine in the amount of up to four thousand monthly calculation indices, or correctional labor in the same amount, or community service for up to one thousand hours, or restriction of liberty for up to four years, or imprisonment for the same period, with confiscation of property, with deprivation of the right to hold certain positions or engage in certain activities. activities for a period of up to five years.

3 The acts provided for in the first or second parts of this Article, committed:

     1) in relation to rare and endangered species of animals, as well as animals on which a ban on use has been imposed, including sturgeon species of fish;

     2) on spawning grounds, in breeding grounds of other aquatic animals or on migration routes to them;

     3) by a person using his official position;

     4) a group of persons, a group of persons by prior agreement;

     5) using a self-propelled floating vehicle;

     6) in specially protected natural territories and in territories with an environmental emergency, –

     are punishable by a fine in the amount of up to six thousand monthly calculation indices, or correctional labor in the same amount, or restriction of liberty for a term of three to six years, or imprisonment for the same term, with confiscation of property, with deprivation of the right to hold certain positions or engage in certain activities for up to seven years.

4 The acts provided for in the first, second or third parts of this Article, committed:

     1) causing major damage;

     2) a criminal group;

     3) a person deprived of the right to engage in activities related to the extraction of fish resources, other aquatic animals or plants, –

     are punishable by imprisonment for a term of six to ten years with confiscation of property, with deprivation of the right to hold certain positions or engage in certain activities for a term of up to ten years.
