The developer has the right to build an apartment building according to any project that does not violate the established building and other mandatory norms and rules and is coordinated with the architectural and urban planning service of the local executive body of the city of republican significance, capital, district (city of regional significance).

The dimensions of an apartment building and other buildings located on a fixed estate plot in accordance with the established procedure are determined by the individual developer independently, provided that their external dimensions (including height) ensure the established mandatory regulatory, sanitary, fire-fighting and technical gaps between these buildings, as well as buildings on adjacent land plots.

The Law of the Republic of Kazakhstan dated November 3, 1994 No. 213.

The purpose of this Law is to create a legal framework for regulating relations between the state, local executive bodies and citizens of the Republic of Kazakhstan who act as developers (owners) of individual residential buildings in order to implement the constitutional right to housing.
