Article 3. Legislation on public associations of the Law on Public Associations
The legislation of the Republic of Kazakhstan on public associations is based on the Constitution of the Republic of Kazakhstan and consists of this Law and other legislative acts that do not contradict them.
This Law applies to all public associations established on the initiative of citizens, with the exception of religious associations, local self-government bodies and public self-activity, the procedure for the establishment and activities of which are determined by other legislative acts.
This Law applies to the activities of structural subdivisions (branches and representative offices) of foreign and international non-profit non-governmental organizations established and operating in the territory of the Republic of Kazakhstan, with the exception of religious ones.
If an international treaty ratified by the Republic of Kazakhstan establishes rules other than those provided for by this Law, the rules of the international treaty shall apply.
The specifics related to the creation, operation, reorganization and liquidation of political parties, trade unions, self-regulatory organizations based on voluntary membership (participation), and other separate types of public associations may be regulated by other legislative acts of the Republic of Kazakhstan. The activities of these public associations, which are not regulated by other legislative acts of the Republic of Kazakhstan, are regulated by this Law.
The right to freedom of association is one of the most important and constitutional human and civil rights, the realization of which meets the interests of society and is protected by the State.
