Article 29. Responsibility of accomplices of a criminal offense of the Criminal Code of the Republic of Kazakhstan, the Criminal Code of the Republic of Kazakhstan
The criminal liability of accomplices is determined by the nature and degree of involvement of each of them in the commission of a criminal offense.
The co-executors are responsible under the same article of this Code for a criminal offense jointly committed by them without reference to article 28 of this Code.
The responsibility of the organizer, instigator and accomplice comes under the article providing for punishment for the committed act, with reference to article 28 of the present Code, except in cases when they were simultaneously co-executors.
If the perpetrator fails to complete the crime due to circumstances beyond his control, the remaining accomplices are responsible for complicity in the preparation for the crime or in the attempted crime. A person who, due to circumstances beyond his control, has failed to persuade others to commit this act is also criminally responsible for preparing for a crime.
A person who is not the subject of a criminal offense specifically specified in the relevant article of the Special Part of this Code, who participated in the commission of an act provided for in this article, shall bear criminal responsibility for this criminal offense as its organizer, instigator or accomplice.
