Article 238. Grounds for state registration of the dissolution of marriage (matrimony) of the Marriage (Matrimony) and Family Code of the Republic of Kazakhstan
1. The grounds for state registration of the dissolution of marriage (matrimony) are a joint application of the spouses for the dissolution of marriage (matrimony), the application of one of the spouses in accordance with the established procedure, who has the right to terminate the marriage (matrimony).
2. The state registration of the dissolution of marriage (matrimony) in the registration authorities, foreign institutions of the Republic of Kazakhstan is carried out with the mutual consent to the dissolution of marriage (matrimony) of spouses who do not have common minor children, and the absence of property and other claims against each other.
3. Excluded by the Law of the Republic of Kazakhstan dated 07.07.2020 No. 361-VI (effective ten calendar days after the date of its first official publication).
4. Regardless of whether the spouses have common minor children, the marriage (matrimony) is dissolved in the registration authorities, foreign institutions of the Republic of Kazakhstan at the request of one of the spouses on the basis of:
1) a court decision that has entered into legal force recognizing the spouse as missing;
2) a court decision that has entered into legal force recognizing the spouse as legally incompetent or with limited legal capacity;
3) a court verdict on the conviction of the spouse for committing a crime to imprisonment for a term of at least three years.
4) decisions of the criminal prosecution body on the international wanted list upon the expiration of three years from the date of its authorization by the court.
