Article 21. Digital records of the Digital Code of the Republic of Kazakhstan
1. A digital record is a separate digital object that represents information recorded in digital form or information about such information that has unique identification characteristics that make it possible to establish the content, source, structure or purpose of the record.
2. Digital records are divided into:
1) identification digital records – recording information or information of an actual, personal or official nature and intended for the individualization of digital data;
2) legally valid digital records – certifying the emergence, ownership, transfer, encumbrance or termination of rights to digital and (or) tangible objects, including things, goods, raw materials and other assets, as well as the rights of claim related to such objects.
3. Identification digital records, including those containing personal data, are not involved in civil circulation, and the rights to their content (information) are protected as intangible assets (personal non-property rights) or information with limited access in accordance with the legislation of the Republic of Kazakhstan.
4. Digital records containing personal data provided to government agencies are used by government agencies only on the basis and within the limits established by the laws of the Republic of Kazakhstan, without the state having ownership rights to such data, except in cases expressly provided for by the laws of the Republic of Kazakhstan.
5. Legally valid digital records allow for the transfer, alienation, encumbrance or other disposal of relevant property rights. The specifics of the creation, use, accounting and turnover of legally valid digital records are established by the legislation of the Republic of Kazakhstan on digital assets.
