Article 20. The procedure for detaining individuals who violated curfew rules The Law On the State of Emergency
1. Individuals who violate the rules of the curfew are detained by law enforcement officers (police) or patrols from among employees and military personnel of state bodies involved in ensuring the state of emergency until the end of the curfew, and those who do not have identification documents with them are detained until their identity is established, but no more than 48 hours by decision of the head of the internal affairs body or his deputy. Detained persons and their belongings and vehicles may be searched.
2. The decision of the head of the internal affairs body or his deputy on detention may be appealed to a higher official, prosecutor, or court in accordance with the procedure established by the laws of the Republic of Kazakhstan.
3. In the event of quarantine due to the threat of the spread of dangerous infectious diseases of humans and animals in an area where a state of emergency has been imposed, individuals who violate the state of emergency, who do not live in the specified area and are otherwise subject to mandatory expulsion from its borders, are detained on general grounds until the expiration of the period of observation established by the health authorities.
4. The procedure for the detention of detained persons is determined by the legislation of the Republic of Kazakhstan on administrative offenses.

This Law establishes the grounds, terms, procedure for the introduction and operation of a state of emergency throughout the territory of the Republic of Kazakhstan or in its individual localities, and the legal regime of a social emergency.
