Article 20. Risk management and internal control system in the field of traffic The Law on Road Traffic
1. The traffic risk management system is aimed at minimizing the likelihood of road accidents, as well as severe consequences (deaths and injuries) as a result of road accidents.
2. The road traffic risk management system is a continuously structured process carried out by government agencies in the field of road traffic to identify, assess, monitor, reduce risks and their consequences affecting the state of road safety.
3. The risk management process includes the following steps:
1) identification of risks:
assessment of risk and risk-forming factors (systematic and continuous monitoring, analysis of all possible causes of road accidents, qualitative assessment of their probability and size);
risk classification (study of the specifics of risks and the factors that lead to their occurrence and influence their development, expert assessments of historical data, risk map);
2) risk measurement (assessment), the frequency of which is determined depending on the significance of the risk, but at least twice a year;
3) implementation of risk analysis;
4) selection and application of a risk management method;
5) adjusting the risk management system in the field of traffic;
6) planning and carrying out control measures.
4. State bodies engaged in activities in the field of road traffic shall form a risk management and internal control system in the field of road traffic, which should include:
1) the powers and functional responsibilities for risk management and internal control of officials of central and local executive bodies, their responsibilities;
2) risk management and internal control procedures;
3) limits on the permissible amount of risks individually according to their classification in the field of traffic;
4) internal procedures for reporting on risk management and internal control to the authorized body, central and local executive bodies;
5) internal criteria for evaluating the effectiveness of the risk management system in the field of traffic.
The procedure for forming a risk management and internal control system in the field of road traffic is established by central and local executive bodies within their competence.
5. The criteria for assessing the degree of risk in the field of traffic are approved by a joint order of the control and supervision authorities and the authorized body and are published on the official Internet resources of government agencies.
6. Planning of control activities by state bodies is carried out on the basis of the risk management system in the field of traffic established by this Law.
The Law of the Republic of Kazakhstan dated April 17, 2014 No. 194-V SAM.
This Law establishes the legal basis and general conditions for the functioning of road traffic and ensuring its safety in the Republic of Kazakhstan.
