Article 20. Requirements for restoration of degraded soil The Law of the Republic of Kazakhstan On Soil Protection   

      1. Compensation for the costs of owners of land plots and land users for the restoration of degraded soil shall be carried out at the expense of the persons whose actions or inaction led to the specified consequences.

      2. Measures for the restoration of degraded soil shall be developed based on scientifically grounded methods and techniques for soil restoration, taking into account the type and degree of its degradation, the natural capacity of the soil for self-restoration and self-purification, as well as the designated purpose of the land plots.

      3. When restoring degraded soil, a special regime for the use of land plots with such soils may be introduced, aimed at reducing anthropogenic pressure and ensuring soil restoration, and providing for the introduction of restrictions or a prohibition on individual types of land use.

      4. When restoring polluted soil, the removal of polluted soil layers may be carried out. The removed soil layers, after restoration, shall be returned to the land plots from which they were removed, provided they comply with environmental standards, or may be used for the restoration of soil on other land plots.

      5. For the purpose of preventing further soil degradation, in the event that the restoration of its fertility is impossible, the conservation of such land plots shall be carried out in accordance with the procedure established by the land legislation of the Republic of Kazakhstan. 

On soil protection, the Law of the Republic of Kazakhstan dated July 8, 2026 No. 341-VIII SAM 

This Law regulates public relations in the field of soil protection and defines their legal, economic and organizational bases.
