Article 2. The right of citizens to receive land plots and build individual residential buildings of the Law on Individual Housing Construction
Every citizen of the Republic of Kazakhstan has the right to receive a land plot for the construction of an individual residential building on the territory of the Republic, regardless of his place of permanent residence, in accordance with the land legislation of the Republic of Kazakhstan.
The presence of a citizen's house or apartment by right of ownership, or an apartment in houses of the state and public housing stock, which he uses under a lease or lease agreement, a country or garden land plot is not a reason for refusing to provide a land plot for the construction of an individual residential building.
Citizens who own residential buildings on suburban and garden plots are granted the right to re-register these properties as individual residential buildings, provided they comply with the standards for residential buildings and buildings, as well as changing the purpose of the land.
The Law of the Republic of Kazakhstan dated November 3, 1994 No. 213.
The purpose of this Law is to create a legal framework for regulating relations between the state, local executive bodies and citizens of the Republic of Kazakhstan who act as developers (owners) of individual residential buildings in order to implement the constitutional right to housing.
