Article 2. State policy and principles of railway transport operation of the Railway Transport Act

     The footnote. Title of Article 2 as amended by the Law of the Republic of Kazakhstan dated 07/04/2013 No. 132-V (effective ten calendar days after its first official publication).

     1. The functioning of railway transport is based on the following principles:

     1) preservation and strengthening of the unified socio-economic space of the Republic of Kazakhstan;

     2) consistency in the functioning of the unified transport system of the Republic of Kazakhstan;

     3) maintaining the integrity and uninterrupted functioning of the railway transport infrastructure;

     4) ensuring the safety, continuity and continuity of the transportation process;

      5) free access of all subjects of the transport market to the provision and receipt of railway transport services;  

      6) protection of the economic interests of the Republic of Kazakhstan;  

     7) the application of a single standard of legal and economic guarantees for all participants in transportation.

     2. The state policy in the field of railway transport is aimed at creating conditions for meeting the needs of the population and the state in transportation. The objectives of the state policy in the field of railway transport are:

     1) development of the mainline railway network and rolling stock of railway transport;  

     2) Transportation development;  

     3) ensuring the safety of railway transport and its life cycle processes for human life and health and the environment;  

     4) implementation of tariff, tax and customs policy in railway transport in accordance with the legislation of the Republic of Kazakhstan;

     5) creating conditions for the development of entrepreneurship and attracting private investment in railway transport and preventing illegal interference by government agencies in economic activities;

     6) development of competition, including in the field of international transportation;  

     7) preservation of a single property complex of the main railway network;  

     8) Environmental protection;  

     9) maintaining the mobilization readiness of railway transport;  

     10) assistance in the development of import-substituting industries for the needs of railway transport;

     11) expansion of transit and international transportation;

     12) ensuring a balance of interests of the state, participants in the transportation process and the auxiliary service of railway transport;

     13) development of the transport and logistics system and an increase in freight flows along railway tracks.

     3. The formation and implementation of the state policy in the field of railway transport are entrusted to the authorized body and other state bodies in accordance with their competence.

 

 

The Law of the Republic of Kazakhstan dated December 8, 2001 No. 266.

      This Law regulates public relations between carriers, participants in the transportation process, government agencies, passengers, senders, recipients, shippers, consignees, and other individuals and legal entities when transporting passengers, baggage, cargo, baggage, and mail by rail.
