Article 18. Official duties and rights of employees, military personnel of the State Security Service of the Republic of Kazakhstan of the Law on the State Security Service of the Republic of Kazakhstan
1. Employees and military personnel of the State Security Service of the Republic of Kazakhstan are obliged to:
1) professionally and accurately solve the tasks assigned to them;
2) maintain the necessary level of professional and legal knowledge, physical, special and combat training.
2. Employees, military personnel of the State Security Service of the Republic of Kazakhstan, when performing their official duties, within the limits and in accordance with the procedure provided for by current legislation, have the right:
1) require citizens and officials to comply with the established procedure in places where security measures are carried out;
2) to identify, prevent and suppress offenses;
3) check, if necessary, the identity documents of citizens and officials.;
4) detain and deliver citizens to the internal affairs bodies, office premises of other law enforcement or special state bodies in case they commit offenses;
5) to use for official purposes the means of communication belonging to organizations, and in urgent cases and citizens;
6) to use for official purposes the vehicles of organizations (except for vehicles belonging to diplomatic, consular and other representations of foreign states and international organizations) for the prevention of criminal offenses, prosecution and detention of persons who have committed criminal offenses or suspected of committing them, for the delivery of persons in need of urgent medical care to medical institutions, as well as for driving to the scene of the accident;
7) freely enter residential and other premises belonging to citizens, the territory and premises of enterprises, institutions and organizations, regardless of their forms of ownership (except for diplomatic consular and other representative offices of foreign states and international organizations), when suppressing criminal and administrative offenses that endanger protected persons and facilities, as well as when prosecuting suspects in the commission of such criminal and administrative offenses, if delay may pose a real threat to protected persons and facilities;
8) excluded by the Law of the Republic of Kazakhstan dated December 28, 2016 No. 36-VI (effective two months after the date of its first official publication);
9) temporarily restrict or prohibit the movement of vehicles and pedestrians on streets and roads, prevent citizens from entering certain areas and facilities, oblige them to stay in specific areas or facilities or leave these areas or facilities in order to ensure the safety of protected persons and facilities.
The use of physical force, special means, weapons and military equipment by employees and military personnel of the State Security Service of the Republic of Kazakhstan is carried out in accordance with the laws of the Republic of Kazakhstan.
It is prohibited to involve employees, military personnel of the State Security Service of the Republic of Kazakhstan to perform functions not related to their official duties.
