Article 18. Ensuring urban planning requirements when using land plots of the Building Code of the Republic of Kazakhstan
The use of land plots by owners or land users for development (including laying communications, engineering preparation of the territory, landscaping, landscaping and other types of site development), as well as for the expansion or reconstruction of buildings (structures, structures) may be carried out only in accordance with urban planning projects approved in accordance with the procedure established by the legislation of the Republic of Kazakhstan and in compliance with the intended purpose or easement, zoning of the territory, red lines and building regulation lines, the rules for the organization of construction and the passage of licensing procedures in the field of construction, as well as in compliance with the prohibitions established on the territory of the forbidden zone and the forbidden area at the arsenals, bases and warehouses of the Armed Forces of the Republic of Kazakhstan, other troops and military formations.
In the event that a land plot is subject to alienation for state needs in connection with the approval of a new one or the introduction of changes to an approved master plan or a detailed planning project or a scheme for the development and development of settlements, the owner or land user uses this land plot for its intended purpose in accordance with the urban planning requirements in force before the approval of a new one or the introduction of changes to an approved master plan or a detailed planning project or a scheme for the development and development of settlements, before the seizure of land plots for state needs.
