Article 17. The rights and obligations of users of weapons of the Law on State Control over the turnover of Certain Types of Weapons

Article 17. The rights and obligations of users of weapons of the Law on State Control over the turnover of Certain Types of Weapons

      1. Gun users have the right to:  

      1) to keep, store and carry weapons in accordance with the right granted to them;  

      2) use weapons in cases and in accordance with the procedure established by the legislation of the Republic of Kazakhstan.  

      2. Users of weapons are required to:  

      1) use the weapon according to its intended purpose;  

      2) observe the established procedure for transporting weapons and ammunition to them;  

      3) to ensure the safety of weapons and ammunition in use;  

      4) comply with safety requirements when using weapons and ammunition.  

     3. Users of weapons – legal entities are obliged to:

     1) to store weapons in specially equipped storages (armories) in an unsuitable condition for firing;

     2) store the main (component) parts of the weapon directly involved in the production of the shot in separate safes;

     3) ensure unhindered access of law enforcement officers to the territory of controlled facilities and weapons storage facilities, provide them with the necessary documentation for familiarization in accordance with the legislation of the Republic of Kazakhstan.

     4. Users of weapons – individuals in accordance with the legislation of the Republic of Kazakhstan are obliged to:

     1) present, at the request of law enforcement officers, the available weapons, ammunition for them and their storage locations, as well as the necessary documentation for the purpose of monitoring compliance with the rules for the safe handling of civilian and service weapons.;

     2) pass a five-year knowledge test of the rules for the safe handling of civilian and service weapons in organizations designated by the authorized body in the field of arms control.

 

 

The Law of the Republic of Kazakhstan dated December 30, 1998 No. 339.

      This Law regulates legal relations arising from the turnover of civilian, service, military handguns and cold steel weapons in the territory of the Republic of Kazakhstan, and is aimed at protecting the life and health of citizens, property, ensuring public safety, protecting environmental facilities, resources, and developing international cooperation in combating crime and illegal proliferation of weapons.  

      The provisions of this Law also apply to the circulation of ammunition (cartridges).
