1. Open data is digital data presented in machine-readable form and intended for free use, processing, republication and dissemination, placed in the public domain.

2. The Internet portal of open data is the state digital resource for the centralized placement, description, storage, search, access and reuse of open digital data, as well as the provision of software interfaces for machine access to such data.

3. The Open Data Internet portal provides free, open and non-discriminatory access to the open data posted on it, with the exception of technical limitations related to ensuring the stability, security or performance of the portal.

4. The operator ensures its technical support, cybersecurity, uninterrupted availability, relevance of the posted open data, as well as logging of the actions of the portal's users in accordance with the procedure determined by the authorized body.

5. Information holders, as defined by the Law of the Republic of Kazakhstan "On Access to Information", are required to post open data on an ongoing basis and timely update it on the Internet portal of open data in accordance with the legislation of the Republic of Kazakhstan on access to information.

6. Other subjects of the digital environment not specified in this article have the right to voluntarily send digital data that does not contain information with limited access for publication on the Internet portal of open data.

7. Digital data that has become available to an unlimited number of people as a result of their leakage, error, security breach, misuse, access to them or other illegal actions are not open data and are subject to immediate deletion from digital resources in accordance with the procedure established by the legislation of the Republic of Kazakhstan, with notification of the authorized body in the field of cybersecurity and The National Security Committee of the Republic of Kazakhstan.
