Article 16. The rights and obligations of organizations in the field of civil protection of the Law on Civil Protection
1. Organizations have the right to:
1) submit proposals to state and local government bodies on ensuring civil protection;
2) carry out work to establish the causes and circumstances of accidents, incidents and fires that have occurred at their facilities;
3) establish social and economic incentive measures to ensure civil protection within the limits defined by the legislation of the Republic of Kazakhstan;
4) receive information on civil protection issues;
5) to create, reorganize and liquidate, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, a professional fire service, which they maintain at their own expense, as well as to involve a professional fire service on the basis of contracts;
6) to carry out an assessment of risks in the field of industrial safety.
2. Organizations are required to:
1) comply with the requirements established by the legislation of the Republic of Kazakhstan in the field of civil protection, as well as comply with the instructions for the elimination of violations issued by state inspectors;
2) develop and implement measures to ensure industrial and fire safety;
3) carry out fire prevention propaganda, as well as train their employees in fire safety measures;
4) excluded by the Law of the Republic of Kazakhstan dated 06/24/2025 No. 196-VIII (effective ten calendar days after the date of its first official publication).
5) keep fire extinguishing systems and equipment in good condition and prevent their improper use;
6) assist in extinguishing fires, eliminating accidents, establishing the causes and conditions of their occurrence and development, as well as in identifying persons who have committed violations of fire and industrial safety requirements, fires and accidents, and provide access to civil protection units when performing their official duties on the territory of organizations in accordance with the procedure established by the legislation of the Republic of Kazakhstan;
7) to provide, at the request of authorized bodies in the field of civil protection and industrial safety and their state inspectors, information and documents on the state of fire and industrial safety, including the fire danger of their products, as well as fires, accidents, incidents and their consequences that have occurred in their territories;
8) immediately inform the fire service about fires that have occurred, changes in the condition of roads and entrances;
9) provide information in accordance with the procedure established by the legislation of the Republic of Kazakhstan, notify employees and the public about the threat or occurrence of emergency situations.;
10) in cases stipulated by the legislation of the Republic of Kazakhstan, provide compensation for damage (damage) caused as a result of emergency situations to employees and other citizens, carry out measures to improve the environment and restore the economic activities of individuals and legal entities after emergency situations are eliminated.;
11) plan and implement measures to protect workers and industrial and social facilities from emergencies.

3. Organizations that have hazardous production facilities and (or) are involved in work on them, in addition to paragraph 2 of this Article, must:

1) apply technologies, dangerous technical devices, explosives and products based on them, approved for use in the territory of the Republic of Kazakhstan;

2) organize and carry out production control over compliance with industrial safety requirements;
IZPI's note! Paragraph 3 is provided to be supplemented with subparagraph 2-1) in accordance with the Law of the Republic of Kazakhstan dated 06/24/2025 No. 196-VIII (effective from 01.01.2026).
3) to carry out inspection and diagnostics of industrial buildings, technological facilities;
IZPI's note! Subparagraph 4) is provided for in the wording of the Law of the Republic of Kazakhstan dated 06/24/2025 No. 196-VIII (effective from 01.01.2026).
4) to carry out technical inspections of technical devices used at hazardous production facilities, as well as those specified in paragraph 2 of Article 71 of this Law;

5) to carry out an examination of technical devices that have completed their standard service life in order to determine the possible duration of their further safe operation;
6) to allow officials and employees who meet the established requirements of industrial safety to work at hazardous production facilities;
7) take measures to prevent unauthorized persons from entering hazardous production facilities;
8) to analyze the causes of accidents, incidents, and losses of explosives and products based on them, and to take measures aimed at preventing and eliminating the harmful effects of hazardous production factors and their consequences;
9) immediately inform employees, the professional emergency rescue service in the field of industrial safety, the territorial body of the authorized body and the territorial subdivision of the department of the authorized body in the field of industrial safety, local executive bodies, and in the event of hazardous production factors - the population falling into the estimated emergency zone.;

10) keep records of accidents, incidents, and losses of explosives and products based on them at hazardous production facilities;
11) provide for the costs of ensuring industrial safety when developing plans for the financial and economic activities of a hazardous production facility;
12) provide information about injuries and incidents to the territorial divisions of the department of the authorized body in the field of industrial safety;
12-1) provide to the territorial divisions of the department of the authorized body in the field of industrial safety information on the accounting (receipt, expenditure, issue and return) of explosives and products based on them used in the production of explosive work at hazardous production facilities;
13) provide the state inspector with personal protective equipment and safety devices when at a hazardous production facility;

14) ensure timely updating of technical devices that have completed their standard service life;

15) declare the industrial safety of hazardous production facilities defined by this Law;
16) ensure the staffing of employees of a hazardous production facility in accordance with the requirements established by the legislation of the Republic of Kazakhstan;

17) provide training, retraining and verification of knowledge of specialists and employees in the field of industrial safety;

18) conclude contracts with professional emergency rescue services in the field of industrial safety for preventive and mine rescue, gas rescue, and anti-spontaneous operations at hazardous production facilities or create professional facility emergency rescue services in the field of industrial safety;
19) excluded by the Law of the Republic of Kazakhstan dated 04/01/2021 No. 26-VII (effective ten calendar days after the date of its first official publication); IZPI's note! Subparagraph 20) is amended by the Law of the Republic of Kazakhstan dated 06/24/2025 No. 196-VIII (effective from 01.01.2026).
20) carry out registration and de-registration of hazardous production facilities;
21) coordinate project documentation for the construction, expansion, reconstruction, modernization, conservation and liquidation of a hazardous production facility in accordance with this Law and the legislation of the Republic of Kazakhstan on architectural, urban planning and construction activities;

22) during the commissioning of a hazardous production facility, conduct acceptance tests and technical inspections with the participation of a state inspector;

23) to maintain professional facility emergency rescue services in the field of industrial safety in readiness with the provision of equipment, necessary equipment, insurance and personal protective equipment for emergency rescue operations;
24) plan and implement measures to localize and eliminate possible accidents and their consequences at hazardous production facilities;
25) have reserves of material and financial resources for carrying out work in accordance with the disaster management plan;
26) create monitoring, communication and support systems for actions in the event of an accident or incident at hazardous production facilities and ensure their sustainable operation;
27) provide training for employees in the event of an accident or incident at hazardous production facilities;
28) create and maintain local notification systems in constant readiness.
4. Subparagraph 18) of paragraph 3 of this Article does not apply to organizations that have hazardous production facilities and (or) are involved in work on them, if they only carry out work on these facilities.:
geological exploration, except for the exploration of hydrocarbons, and mining operations for the extraction of common minerals without drilling and blasting operations;

work using lifting mechanisms;
works related to the operation of gas stations and bread receiving points.
5. Organizations classified in the categories of civil defense in addition to paragraph 2 of this article are required to:
1) develop and implement civil defense plans;
2) develop, approve and implement action plans for the elimination of facility-related emergencies and their consequences;
3) carry out civil defense measures to protect workers and facilities in the conduct of military conflicts;
4) provide training for civil defense workers;
5) create stocks and maintain collective and individual protective equipment in constant readiness;
6) organize emergency rescue and emergency operations at their facilities.

This Law regulates public relations arising in the process of carrying out civil protection measures and is aimed at preventing and eliminating natural and man-made emergencies and their consequences, providing emergency medical and psychological assistance to the population in the emergency zone, ensuring fire and industrial safety, and also defines the main tasks and organizational principles of building and the functioning of the civil defense of the Republic of Kazakhstan, the formation of, storage and use of the state material reserve, organization and activities of emergency services and formations.
