Article 16. Duties of employees related to law enforcement service The Law on Law Enforcement Service

    1. Employees are required to:

     1) comply with the Constitution of the Republic of Kazakhstan and the legislation of the Republic of Kazakhstan;

     2) ensure the observance and protection of human and civil rights and freedoms, as well as the legitimate interests of individuals and legal entities, and the state;

     3) to consider, in the manner and within the time limits established by law, the appeals of individuals and legal entities, and to take the necessary measures on them;

     4) exercise powers within the limits of the rights granted to them and in accordance with their official duties;

     5) observe official and labor discipline;

     6) assume restrictions related to the employee's stay in law enforcement service and anti-corruption restrictions established by the Law of the Republic of Kazakhstan "On Combating Corruption";

     7) comply with the requirements of the Code of Ethics for employees of Law enforcement Agencies, civil protection agencies and the State Courier Service of the Republic of Kazakhstan, approved by the President of the Republic of Kazakhstan;

     8) to carry out lawful orders and orders of managers, decisions and instructions of higher authorities and officials issued within their authority;

     9) to keep state secrets and other legally protected secrets, including after the termination of law enforcement service for the time prescribed by law, for which a subscription is given;

     10) to keep secret information received in the performance of official duties affecting the private life, honor and dignity of citizens, and not to require them to provide such information, except in cases provided for by law;

     11) to ensure the safety of state property;

     12) submit a report in writing and immediately inform the immediate and authorized supervisor in cases where the employee's private interests overlap or conflict with their authority.;

     13) improve their professional level and qualifications;

     14) to prevent public appearances that harm the interests of the civil service;

     15) inform the immediate supervisor in writing about the fact that an employee or his spouse has applied for renunciation of citizenship of the Republic of Kazakhstan or about the fact of applying for acquisition of foreign citizenship on the day of application;

     16) excluded by the Law of the Republic of Kazakhstan dated 18.11.2015 No. 412-V (effective from 01.01.2021).

     2. Employees, in accordance with the tasks assigned to them, within their competence, are assigned other duties provided for by the laws of the Republic of Kazakhstan regulating the activities of law enforcement agencies and other legislation of the Republic of Kazakhstan.

     3. If employees violate human and civil rights and freedoms, as well as the legitimate interests of individuals and legal entities, law enforcement agencies are required to restore these rights, compensate for the damage caused, and ensure that those responsible are held accountable in accordance with the laws of the Republic of Kazakhstan.

 

The Law of the Republic of Kazakhstan dated January 6, 2011 No. 380-IV.

     This Law regulates public relations related to admission to the law enforcement service of the Republic of Kazakhstan, its passage and termination, and also defines the legal status (status), financial support and social protection of law enforcement officers of the Republic of Kazakhstan.
