Article 15. National Academy of Sciences of the Republic of Kazakhstan The Law on Science and Technology Policy
1. The National Academy of Sciences of the Republic of Kazakhstan (hereinafter referred to as the National Academy of Sciences) is established by the Government of the Republic of Kazakhstan in the form of a higher scientific organization.
2. The National Academy of Sciences unites individuals who are members of the National Academy of Sciences, who are elected in accordance with the procedure determined by the authorized body.
3. National Academy of Sciences:
1) develops recommendations for determining priority areas of scientific and (or) scientific and technical activities in accordance with the priorities of socio-economic development, as well as priority areas of strategic, fundamental and applied scientific research in the Republic of Kazakhstan;
2) conducts an analysis of strategic priority areas for the development of science and technology, submitted by the authorized body to the National Council for Science and Technology under the President of the Republic of Kazakhstan;
3) conducts an expert examination of scientific and technical assignments submitted to the Higher Scientific and Technical Commission for program-specific financing;
4) prepares and conducts foresight (predictive) research on the development of science;
5) conducts competitions for nominal prizes and scholarships in the field of science;
6) conducts scientific research in various fields of science and technology;
7) publishes scientific journals;
8) participates in the development of international scientific and scientific-technical cooperation;
9) participates in the popularization of science;
10) exercises other powers established by the legislation of the Republic of Kazakhstan.
4. The governing bodies of the National Academy of Sciences are:
1) the supreme body is the Board of Trustees (hereinafter referred to as the Council);
2) the representative body is the General Meeting of academicians of the National Academy of Sciences (hereinafter referred to as the meeting);
3) the consultative and advisory body is the Presidium (hereinafter referred to as the Presidium);
4) the executive body is the Management Board (hereinafter referred to as the Management Board).
The governing bodies of the National Academy of Sciences, their structure, competence, formation procedure, terms of office of members of governing bodies, and decision–making procedure are established by the legislation of the Republic of Kazakhstan and the charter of the National Academy of Sciences (hereinafter referred to as the charter), approved by the authorized body in coordination with the authorized body for state property.
5. The Chairman of the Council is a person appointed by the Government of the Republic of Kazakhstan.
The exclusive competence of the Council includes:
1) approval of the strategy and development plan of the National Academy of Sciences, review of the reports of the National Academy of Sciences on the progress of their implementation;
2) assistance in the implementation of state policy in the field of science and scientific and technological policy;
3) development of proposals to improve the efficiency of the National Academy of Sciences;
4) reviewing information on the implementation of the activities of the National Academy of Sciences, the implementation of decisions taken by the governing bodies of the National Academy of Sciences, as well as making recommendations to other governing bodies of the National Academy of Sciences based on the results of consideration of issues at meetings of the Board of Trustees of the National Academy of Sciences;
5) review information on the results of the activities of the National Academy of Sciences, develop recommendations based on the results of the review of such information.
The Council may exercise other powers established by the legislation of the Republic of Kazakhstan, the charter and the regulations on the Council.
6. The number of council members must be at least five. Members of the executive body may not be elected to the Board.
7. A meeting of the Council is held at least once a year. An extraordinary meeting is held by decision of the Management Board or at the request of at least twenty percent of the board members.
8. The members of the Council must be notified of the upcoming meeting at least three days in advance.
9. At the request of at least twenty percent of the council members present at the meeting, a decision is taken by secret ballot.
10. The meeting of the Council is chaired by the Chairman, and in his absence – by one of the council members.
11. The Council's decision is made by a majority vote of the Council members. Each member of the Council has one vote.
12. The Assembly carries out the general management of the activities of the National Academy of Sciences.
13. The Chairman of the meeting is the first head of the National Academy of Sciences.
The assembly consists of academicians of the National Academy of Sciences, elected in accordance with the rules and criteria for the election of academicians of the National Academy of Sciences, determined by the authorized body.
The quantitative composition and terms of office of the meeting are established by the charter.
14. The exclusive competence of the assembly includes:
1) election of academicians of the National Academy of Sciences, members of the Presidium of the National Academy of Sciences, with the exception of members of the transitional Presidium;
2) awarding honorary titles and awards;
3) development of recommendations on the strategy and development plan of the National Academy of Sciences;
4) development of proposals for the participation of the National Academy of Sciences in projects of scientific and (or) scientific and technical activities;
5) hearing and discussing the results of scientific and (or) scientific and technical activities of academicians of the National Academy of Sciences, reports of heads of structural divisions of the National Academy of Sciences and individual scientists;
6) development of recommendations for improving the effectiveness of the National Academy of Sciences.
The Assembly may exercise other powers established by the legislation of the Republic of Kazakhstan and the charter.
15. The meeting is convened by the Chairman within the time limits established by the charter.
16. A meeting of the assembly is recognized as valid if the majority of the members of the assembly participate in it.
17. The rights and duties of the chairman of the meeting are established by the charter.
18. The actions of the members of the assembly or its chairman may be appealed at a meeting of the assembly.
The recommendations of the meeting are mandatory for their consideration by the Presidium and the Management Board.
19. The Presidium ensures the activities of the assembly.
The Chairman of the Presidium is the first head of the National Academy of Sciences.
The Presidium is elected at a meeting of the assembly for a period of at least three years and carries out activities on behalf of the assembly.
The Presidium is formed by a decision of the assembly, with the exception of the transitional presidium.
20. The exclusive competence of the Presidium includes:
1) organization of procedures for the election of academicians of the National Academy of Sciences;
2) ensuring the execution of decisions taken by the Council, the assembly;
3) monitoring the implementation of the program of an academician of the National Academy of Sciences;
4) review and approval of the publication plan (journals, monographs) National Academy of Sciences;
5) development of recommendations for the establishment of badges of academicians of the National Academy of Sciences, scientific prizes, honorary titles, awards (medals) and certificates;
6) Coordination of the implementation of the annual national science report.
The Presidium may exercise other powers established by the legislation of the Republic of Kazakhstan and the Charter.
21. Persons elected to the Presidium may be re-elected no more than twice in a row.
Meetings of the Presidium are convened at least once a quarter.
A meeting may be convened on the initiative or at the request of the council or the meeting no later than three days from the date of receipt of the request for convocation.
The Management Board ensures the organization of meetings of the Presidium and the execution of its decisions.
22. The management of the current activities of the National Academy of Sciences is carried out by the Board. The Chairman of the Board is the first head of the National Academy of Sciences.
The Management Board acts on the basis of and in accordance with the decisions of the Council, the Assembly and the Presidium and is accountable to them.
23. The quantitative composition and term of office of the Management Board are established by the charter and the legislation of the Republic of Kazakhstan.
A meeting of the Management Board is convened by the Chairman within the time limits established by the charter.
24. A meeting of the Management Board is recognized as valid if the majority of the members of the Management Board participate in it.
25. The rights and duties of the Chairman of the Management Board are established by the charter.
26. The exclusive competence of the Management Board includes:
1) development and submission of the organizational structure and staffing of the National Academy of Sciences for approval by the Council;
2) development and submission to the Council for approval of the National Academy of Sciences development plan and reports on its implementation;
3) organization of the implementation of decisions of the Council, the assembly, the Presidium;
4) approval of the Board's report on scientific achievements and other performance results of the National Academy of Sciences;
5) making decisions on the establishment and closure of branches and representative offices of the National Academy of Sciences and approving regulations on their activities.
The Management Board may exercise other powers established by the legislation of the Republic of Kazakhstan and the Charter.
27. An academician of the National Academy of Sciences who has reached the retirement age established by the Social Code of the Republic of Kazakhstan is awarded a monthly lifetime scholarship in the amount and in the manner determined by the Government of the Republic of Kazakhstan.
28. Financing of scientific and (or) scientific and technical activities of the National Academy of Sciences is carried out in accordance with the procedure determined by the Government of the Republic of Kazakhstan, as well as from other sources not prohibited by the laws of the Republic of Kazakhstan.
This Law regulates public relations in the field of science, scientific and (or) scientific and technical activities, commercialization of the results of scientific and (or) scientific and technical activities, defines the basic principles and mechanisms of functioning and development of the national scientific system of the Republic of Kazakhstan.
