Article 15-3. Application of special means of the Law on National Security Agencies of the Republic of Kazakhstan
1. Employees and military personnel of national security agencies have the right to use special weapons in the following cases::
1) to repel attacks on citizens and protected persons;
2) to repel attacks on buildings, structures, premises, other facilities and vehicles protected by national security agencies, as well as to liberate these facilities and facilities in the event of their capture;
3) to identify and suppress criminal offenses;
4) for the disarmament of persons illegally carrying weapons, ammunition, explosives, toxic and radioactive substances;
5) to repel attacks on employees or military personnel of national security agencies, their family members or other persons involved in security measures;
6) to detain offenders, persons who resist or intentionally hinder military personnel or employees of national security or law enforcement agencies in the exercise of their official duties;
7) when escorting and guarding detainees, detained persons, as well as convicted, suspected and accused persons, if there are sufficient grounds to believe that they may escape or harm others or their own health, as well as in relation to persons who hinder employees or military personnel of national security agencies in the exercise of their duties assigned by law.;
8) for the release of hostages, suppression of mass riots, group actions encroaching on the life, health, rights, freedoms, personal dignity and property of citizens, protected persons and objects;
9) to stop a vehicle, the driver of which has not complied with the requirement of an employee or serviceman of the national security agencies to stop, if it is impossible to prevent a real threat to the protected persons by other means.;
10) in cases of necessary defense and extreme necessity;
11) to prevent violations of airspace by unmanned aerial vehicles over the territory of facilities of the national security authorities of the Republic of Kazakhstan.
2. It is prohibited to use special means against a protected person, as well as against women with visible signs of pregnancy, persons with obvious signs of disability, and minors, except in cases where they commit attacks on employees or military personnel of national security agencies, citizens, and protected persons that threaten their lives and health, group attacks, or armed resistance.
3. The list of special means used by national security agencies is approved by the Government of the Republic of Kazakhstan.
This Law defines the status, powers and organization of activities of the national security bodies of the Republic of Kazakhstan.
